1 1 Section 1. Section 257.14, subsection 2, Code 2003, is
1 2 amended to read as follows:
1 3 2. For the budget years commencing July 1, 2002, and July
1 4 1, 2003, and July 1, 2004, if the department of management
1 5 determines that the regular program district cost of a school
1 6 district for a budget year is less than the total of the
1 7 regular program district cost plus any adjustment added under
1 8 this section for the base year for that school district, the
1 9 school district shall be eligible to receive a budget
1 10 adjustment for that district for that budget year up to an
1 11 amount equal to the difference. The board of directors of a
1 12 school district that wishes to receive a budget adjustment
1 13 pursuant to this subsection shall adopt a resolution to
1 14 receive the budget adjustment by April 15, annually, and shall
1 15 notify the department of management of the adoption of the
1 16 resolution and the amount of the budget adjustment to be
1 17 received.
1 18 Sec. 2. Section 257.14, subsection 3, Code 2003, is
1 19 amended by striking the subsection.
1 20 Sec. 3. EFFECTIVE DATE. This Act, being deemed of
1 21 immediate importance, takes effect upon enactment.
1 22 EXPLANATION
1 23 This bill provides for the continuation of the 100 percent
1 24 budget guarantee, currently applicable to school districts for
1 25 the school budget year beginning July 1, 2003, for the school
1 26 budget year beginning July 1, 2004. This enables a school
1 27 district to maintain 100 percent of the previous year's
1 28 budget, adjusted to include the amount of the budget
1 29 adjustment the district received in the previous year. The
1 30 bill eliminates provisions that were passed during the 2001
1 31 Legislative Session which, starting with the school budget
1 32 year beginning July 1, 2004, provided that school districts
1 33 would no longer be eligible for the 100 percent "adjusted"
1 34 guarantee, but would instead be eligible for a 101 percent
1 35 guarantee without the adjustment for inclusion of the previous
2 1 year's guarantee. The bill also eliminates provisions passed
2 2 during the 2001 Legislative Session that provided for an
2 3 optional 10=year phaseout of the 100 percent adjusted
2 4 guarantee for school districts that would lose money based on
2 5 the change to a 101 percent nonadjusted guarantee.
2 6 The bill takes effect upon enactment.
