  1  1    Section 1.  Section 455B.133, subsection 10, Code 2003, is
  1  2 amended to read as follows:
  1  3    10.  Adopt rules allowing a city to conduct a controlled
  1  4 burn of a demolished building subject to the same restrictions
  1  5 as are in effect for fire fighting training fires.  The rules
  1  6 shall include a provision that a city may undertake no more
  1  7 than three five controlled burns in every overlapping six=
  1  8 tenths=of=a=mile=radius circle every three years.  The rules
  1  9 shall prohibit a controlled burn of a demolished building in
  1 10 Cedar Rapids, Marion, Hiawatha, Council Bluffs, Carter Lake,
  1 11 Des Moines, West Des Moines, Clive, Windsor Heights,
  1 12 Urbandale, Pleasant Hill, Buffalo, Davenport, Mason City, or
  1 13 any other area where area=specific state implementation plans
  1 14 require the control of particulate matter.
  1 15                           EXPLANATION
  1 16    This bill relates to controlled burns of demolished
  1 17 buildings.  Currently, cities are prohibited from undertaking
  1 18 more than three controlled burns in every overlapping six=
  1 19 tenths=of=a=mile=radius circle every three years.  The bill
  1 20 increases the number of controlled burns allowed from three to
  1 21 five burns in every overlapping six=tenths=of=a=mile=radius
  1 22 circle every three years.
