  2    disability under the statewide fire and police retirement
  3    system.

  1  1    Section 1.  Section 411.6, subsection 6, paragraph c, Code
  1  2 2003, is amended to read as follows:
  1  3    c.  Upon retirement for accidental disability on or after
  1  4 July 1, 1998, but before July 1, 2003, a member shall receive
  1  5 an accidental disability retirement allowance which shall
  1  6 consist of a pension in an amount equal to the greater of
  1  7 sixty percent of the member's average final compensation or
  1  8 the retirement allowance that the member would receive under
  1  9 subsection 2 if the member had attained fifty=five years of
  1 10 age.
  1 11    Sec. 2.  Section 411.6, subsection 6, Code 2003, is amended
  1 12 by adding the following new paragraph:
  1 13    NEW PARAGRAPH.  d.  Upon retirement for accidental
  1 14 disability on or after July 1, 2003, a member shall receive an
  1 15 accidental disability retirement allowance which shall consist
  1 16 of a pension equal to eighty=two percent of the member's
  1 17 average final compensation.
  1 18                           EXPLANATION
  1 19    This bill changes the retirement allowance a member under
  1 20 the statewide fire and police retirement system (Code chapter
  1 21 411) receives upon an accidental disability.  Under current
  1 22 law, for an accidental disability retirement, the member
  1 23 receives a retirement allowance equal to the greater of 60
  1 24 percent of average final compensation or the benefit amount
  1 25 calculated under a service retirement if the member were 55
  1 26 years of age.  The maximum service retirement for a normal
  1 27 retirement can be 82 percent if the member has served 30 years
  1 28 of service.  Under the bill, the member would receive 82
  1 29 percent for an accidental disability retirement regardless of
  1 30 the years of service the member had at the time of the
  1 31 disability retirement.
