Section 15.269, subsection 2, paragraph b, 1 2 subparagraph (1), subparagraph subdivision (a), Code 1 3 Supplement 2003, is amended to read as follows: 1 4 (a) Each cogeneration pilot project facility must involve 1 5twothree hundred megawatts or less of electricity, in 1 6 combination with one or more other cogeneration project 1 7 facilities. 1 8 Sec. 2. Section 476.1, Code 2003, is amended by adding the 1 9 following new unnumbered paragraph: 1 10 NEW UNNUMBERED PARAGRAPH. This chapter shall not apply to 1 11 an entity that directly or indirectly furnishes electricity 1 12 produced by a cogeneration facility if such entity furnishes 1 13 such electricity to no more than two users who are physically 1 14 located within two miles of the cogeneration facility. 1 15 Sec. 3. Section 476.22, Code 2003, is amended to read as 1 16 follows: 1 17 476.22 DEFINITION. 1 18 As used in sections 476.23 to 476.26, unless the context 1 19 otherwise requires, "electric utility" includes a public 1 20 utility furnishing electricity as defined in section 476.1 and 1 21 a city utility as defined in section 390.1, but does not 1 22 include an entity that directly or indirectly furnishes 1 23 electricity produced by a cogeneration facility if such entity 1 24 furnishes such electricity to no more than two users who are 1 25 physically located within two miles of the cogeneration 1 26 facility. 1 27 EXPLANATION 1 28 This bill relates to electric power generation facilities 1 29 and the cogeneration pilot program. 1 30 The bill relates to the cogeneration pilot program by 1 31 increasing the maximum allowable megawatts of each 1 32 cogeneration pilot project facility from 200 to 300. The bill 1 33 removes the applicability of Code chapter 476 regarding the 1 34 regulation of public utilities to certain entities that 1 35 furnish electricity produced by a cogeneration facility.
