1 An Act relating to the performance of a notarial act by a chief
2 officer when certifying a uniform citation and complaint under
3 oath, and providing an effective date.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 9E.6A, unnumbered paragraph 1, Code
1 2 2003, is amended to read as follows:
1 3 Each person performing a notarial act pursuant to section
1 4 9E.10 must acquire and use a stamp or seal as provided in this
1 5 chapter. However, this section shall not apply to a notarial
1 6 act performed by a judicial officer as defined in section
1 7 602.1101, if the notarial act is performed in accordance with
1 8 state or federal statutory authority, or is a certification by
1 9 a chief officer or a chief officer's designee of a peace
1 10 officer's verification of a uniform citation and complaint
1 11 pursuant to section 805.6, subsection 5.
1 12 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 13 immediate importance, takes effect upon enactment.
1 14 EXPLANATION
1 15 This bill creates an exception to the normal process of
1 16 performing a notarial act with respect to a chief officer's
1 17 certifying under oath of a verification of a uniform citation
1 18 and complaint by a peace officer. Under the bill, the chief
1 19 officer of a law enforcement agency or the chief officer's
1 20 designee is not required to use a stamp or seal when
1 21 certifying the verification of a uniform citation and
1 22 complaint by a peace officer.
1 23 The bill takes effect upon enactment.
