1 An Act relating to environmental regulations administered by the
2 department of natural resources regarding the use of recycled
3 oil and the calculation of waste volume reduction measures.

1 1 Section 1. Section 455B.306, subsection 3, Code 2003, is
1 2 amended to read as follows:
1 3 3. A city or county required to file with the director a
1 4 comprehensive plan detailing the method by which the city or
1 5 county will comply with the requirements of section 455B.302
1 6 to establish and implement a comprehensive solid waste
1 7 reduction program for its residents and which seeks approval
1 8 of the inclusion of refuse=derived fuel as a component of its
1 9 percentage of waste reduction, shall file an annual report
1 10 with the director regarding the percentage of reduction
1 11 attributable to refuse=derived fuel and the justification for
1 12 such inclusion. The director shall approve or reject the
1 13 inclusion. The percentage of reduction attributable to
1 14 refuse=derived fuel and allowable for inclusion shall not
1 15 exceed fifty percent and only those products established as
1 16 allowable pursuant to section 455D.20 shall be included in the
1 17 calculation of the waste reduction goal.
1 18 Sec. 2. Section 455B.412, subsection 5, Code 2003, is
1 19 amended by striking the subsection.
1 20 Sec. 3. Section 455D.20, Code 2003, is repealed.
1 21 EXPLANATION
1 22 This bill relates to environmental regulations administered
1 23 by the department of natural resources regarding the use of
1 24 recycled oil and the calculation of waste volume reduction
1 25 measures.
1 26 The bill eliminates a provision requiring the department of
1 27 natural resources to adopt rules regulating the use of
1 28 recycled oil for the purpose of road oiling, dust control, or
1 29 weed control.
1 30 The bill repeals a provision that allowed the inclusion of
1 31 reduction attributable to refuse=derived fuel in the
1 32 calculation of a city or county in meeting the waste reduction
1 33 goal of the state and makes conforming amendments.
