  3    trout fishing fee requirements, and providing effective and

  1 17    Sec. 3.  Section 483A.1, subsection 2, Code 2003, is
  1 18 amended by adding the following new paragraph:
  1 19    NEW PARAGRAPH.  t.  Fishing license, one=day.........  $  8.50
  1 20    Sec. 4.  Section 483A.3A, Code 2003, is amended by striking
  1 21 the section and inserting in lieu thereof the following:
  1 22    483A.3A  FISH HABITAT DEVELOPMENT FUNDING.
  1 23    Three dollars from each resident and nonresident annual and
  1 24 seven=day fishing license sold shall be deposited in the state
  1 25 fish and game protection fund and shall be used within this
  1 26 state for fish habitat development.  Not less than fifty
  1 27 percent of this amount shall be used by the commission to
  1 28 enter into agreements with county conservation boards to carry
  1 29 out the purposes of this section.
  1 30    Sec. 5.  Section 483A.6, Code 2003, is amended to read as
  1 31 follows:
  1 32    483A.6  TROUT FISHING FEE.
  1 33    Any person required to have a fishing license shall not
  1 34 fish for or possess trout unless that person has paid the
  1 35 trout fishing fee.  The proceeds from the fee shall be used
  2  1 exclusively for the trout program designated by the
  2  2 commission.  The commission may grant a permit to a community
  2  3 event in which trout will be stocked in water which is not
  2  4 designated trout water and a person may catch and possess
  2  5 trout during the period and from the water covered by the
  2  6 permit without having paid the trout fishing fee.
  2  7    Sec. 6.  EFFECTIVE DATE AND APPLICABILITY DATES.  This Act
  2  8 takes effect December 15, 2003, and applies to licenses and
  2  9 fees for fishing and fish habitat activities for the years
  2 10 beginning on or after January 1, 2004.
  2 11                           EXPLANATION
  2 12    This bill raises the license fees for resident and
  2 13 nonresident annual and seven=day fishing licenses.  The bill
  2 14 also adds new categories of one=day resident fishing licenses
  2 15 and three=day and one=day nonresident fishing licenses.
  2 16    The bill eliminates the separate $3 fish habitat fee and
  2 17 provides instead that $3 from each resident and nonresident
  2 18 annual and seven=day fishing license be used for fish habitat
  2 19 development with no less than 50 percent of that amount used
  2 20 by the commission to enter into agreements with county
  2 21 conservation boards to develop fish habitat.
  2 22    The bill also provides that a person who is required to
  2 23 have a fishing license shall not either fish for or possess
  2 24 trout without first paying the trout fishing fee and deletes
  2 25 language requiring all trout fishing fees to be used
  2 26 exclusively for the trout program.  The bill also deletes
  2 27 language allowing the natural resource commission to grant
  2 28 permits to community events to stock trout in water which is
  2 29 not designated trout water and to allow a person to catch and
  2 30 possess trout during the event without paying a trout fishing
  2 31 fee.
  2 32    The bill takes effect December 15, 2003, and is applicable
  2 33 to licenses and fees for fishing and fish habitat activities
  2 34 for years beginning on or after January 1, 2004.
