  1 An Act requiring a valid driver's license for issuance or renewal
  2    of a motor vehicle registration.
  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 321.20, subsection 1, Code 2003, is
  1  2 amended to read as follows:
  1  3    1.  The full legal name; social security number or, if the
  1  4 owner does not have a social security number but has a
  1  5 passport, the passport number; valid driver's license number,
  1  6 whether the license was issued by this state, another state,
  1  7 another country, or is an international driver's license; date
  1  8 of birth; bona fide residence; and mailing address of the
  1  9 owner and of the lessee if the vehicle is being leased.  If
  1 10 the owner or lessee is a firm, association, or corporation,
  1 11 the application shall contain the business address and federal
  1 12 employer identification number of the owner or lessee.  Up to
  1 13 three owners' names may be listed on the application.
  1 14 Information relating to the lessee of a vehicle shall not be
  1 15 required on an application for registration and a certificate
  1 16 of title for a vehicle with a gross vehicle weight rating of
  1 17 ten thousand pounds or more.
  1 18    Sec. 2.  Section 321.40, Code 2003, is amended by adding
  1 19 the following new unnumbered paragraph:
  1 20    NEW UNNUMBERED PARAGRAPH.  The county treasurer shall
  1 21 refuse to renew the registration of a vehicle registered to a
  1 22 person when notified by the department that the person's
  1 23 driver's license has expired or has been suspended, revoked,
  1 24 or canceled.  The department shall notify the county treasurer
  1 25 when the person's driver's license is renewed or reinstated.
  1 26 Upon application by the person to the county treasurer,
  1 27 including proof of a valid driver's license and payment of the
  1 28 proper fees for the unexpired portion of the registration
  1 29 period, the county treasurer shall renew the person's vehicle
  1 30 registration for the remainder of the registration period
  1 31 without penalty.
  1 32    Sec. 3.  IMPLEMENTATION OF ACT.  Section 25B.2, subsection
  1 33 3, shall not apply to this Act.
  1 34                           EXPLANATION
  1 35    This bill requires that an applicant for registration of a
  2  1 motor vehicle or for renewal of a motor vehicle registration
  2  2 have a valid driver's license.  The bill amends Code section
  2  3 321.20 to specify that the driver's license number currently
  2  4 required on applications for a motor vehicle registration and
  2  5 certificate of title must be for a valid driver's license.
  2  6 Current law provides that providing false information on such
  2  7 an application is grounds for refusal of registration and
  2  8 issuance of a certificate of title.
  2  9    The bill adds a provision to Code section 321.40 requiring
  2 10 the state department of transportation to notify county
  2 11 treasurers of drivers whose licenses are expired or suspended,
  2 12 revoked, or canceled, and again when those licenses are
  2 13 renewed or reinstated.  A county treasurer shall refuse to
  2 14 renew a motor vehicle registration for a person whose driver's
  2 15 license is expired or suspended, revoked, or canceled.  When
  2 16 the driver's license of such a person is renewed or
  2 17 reinstated, the person may apply to the county treasurer with
  2 18 proof of a valid driver's license, and the treasurer shall
  2 19 renew the person's motor vehicle registration upon payment of
  2 20 the proper fees for the remainder of the registration period,
  2 21 without penalty.
  2 22    The bill may include a state mandate as defined in Code
  2 23 section 25B.3.  The bill makes inapplicable Code section
  2 24 25B.2, subsection 3, which would relieve a political
  2 25 subdivision from complying with a state mandate if funding for
  2 26 the cost of the state mandate is not provided or specified.
  2 27 Therefore, political subdivisions are required to comply with
  2 28 any state mandate included in the bill.
