HOUSE JOINT RESOLUTION
1 A Joint Resolution to nullify administrative rules of the
2 department of human services relating to case management for
3 persons with mental retardation, chronic mental illness, or
4 developmental disabilities, and providing an effective date.

1 1 Section 1. The amendments to 2003 Iowa administrative
1 2 code, rule 441=78.33, subrules (1) and (2), rule 441=79.1,
1 3 subrule (1), paragraph "d", and subrule (2), rule 441=80.2,
1 4 subrule (2), paragraph "g", rule 441=88.61, rule 441=88.73,
1 5 subrule (2), and rule chapter 441=90, as appearing in ARC
1 6 2233B, as published in the Iowa administrative bulletin,
1 7 volume XXV, number 14, dated January 8, 2003, pp. 999=1003,
1 8 are nullified.
1 9 Sec. 2. EFFECTIVE DATE. This joint resolution, being
1 10 deemed of immediate importance, takes effect upon enactment.
1 11 EXPLANATION
1 12 This joint resolution nullifies administrative rules
1 13 adopted by the department of human services pertaining to
1 14 targeted case management provided under the medical assistance
1 15 (Medicaid) program for adult persons with mental retardation,
1 16 chronic mental illness, or developmental disabilities. The
1 17 rules require that the Iowa plan managed care contractor must
1 18 provide prior authorization and service authorization for the
1 19 case management services.
1 20 The joint resolution takes effect upon enactment.
