HOUSE JOINT RESOLUTION
1 A Joint Resolution authorizing the temporary use and consumption
2 of wine and beer in the State Capitol in conjunction with the
3 2004 Annual Meeting of the Midwestern Legislative Conference
4 of the Council of State Governments.
5 WHEREAS, the State of Iowa is honored to host the Midwestern
6 Legislative Conference of the Council of State Governments in Des
7 Moines, Iowa, on July 11 through 14, 2004; and
8 WHEREAS, this prestigious regional meeting offers an
9 opportunity to develop and maintain contact among legislators,
10 public officials, and the private sector from the states of
11 Illinois, Indiana, Iowa, Kansas, Michigan, Minnesota, Nebraska,
12 North Dakota, Ohio, South Dakota, and Wisconsin; and
13 WHEREAS, social events are held in conjunction with the
14 business sessions of this annual meeting, and Iowa's unique State
15 Capitol is an optimal location for one of the social events for
16 this national meeting; and
17 WHEREAS, wine and beer are customarily served as an
18 accompaniment to the food and entertainment provided at such
19 social events; and
20 WHEREAS, under 11 IAC 100.4(8), which prohibits the
21 consumption of alcoholic beverages on the capitol complex, it is
22 not possible to serve wine and beer at social events in the State
23 Capitol; NOW THEREFORE,
24 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Notwithstanding 11 IAC 100.4(8) and any
1 2 contrary provisions of chapter 123, prohibiting the use and
1 3 consumption of alcoholic beverages in public places, wine and
1 4 beer may be used and consumed within the State Capitol at a
1 5 social event, to be held on or around July 13, 2004, hosted by
1 6 the State of Iowa in conjunction with the 2004 Midwestern
1 7 Legislative Conference of the Council of State Governments, if
1 8 the person providing the food and beverages at the social
1 9 event possesses the appropriate valid liquor control license.
1 10 For the purposes of this section and section 123.95, the State
1 11 Capitol is a private place.
1 12 EXPLANATION
1 13 This joint resolution authorizes the consumption of wine
1 14 and beer at a social event at the state capitol to be held on
1 15 or around July 13, 2004, in conjunction with the 2004 Annual
1 16 Meeting of the Midwestern Legislative Conference of the
1 17 Council of State Governments. Current law and rules otherwise
1 18 prohibit the use and consumption of alcoholic beverages within
1 19 the state capitol.
