Section 476.1, unnumbered paragraph 5, Code 1 2 2003, is amended to read as follows: 1 3 This chapter does not apply to waterworks having less than 1 4 two thousand customers, municipally owned waterworks, joint 1 5 water utilities established pursuant to chapter 389, rural 1 6 water districts incorporated and organized pursuant to 1 7 chapters 357A and 504A, cooperative water associations 1 8 incorporated and organized pursuant to chapter 499, or to a 1 9 person furnishing electricity to five or fewer customers 1 10 either by secondary line or from an alternate energy 1 11 production facility or small hydro facility, from electricity 1 12 that is produced primarily for the person's own use. This 1 13 chapter shall apply to privately owned water wells that supply 1 14 water to more than two, but fewer than thirty, customers, if a 1 15 water rates board governing water rates=related issues of the 1 16 privately owned water well has not been established, with at 1 17 least a majority of the board members consisting of existing 1 18 customers of the water well, which has the jurisdiction, at a 1 19 minimum, to approve or disapprove water rate increases and to 1 20 provide final and binding decisions for water rates 1 21 complaints. 1 22 EXPLANATION 1 23 This bill relates to the jurisdiction of the utilities 1 24 board to regulate rates and services of water distributed from 1 25 a privately owned water well when the well supplies water to 1 26 more than two, but fewer than 30, customers. The bill 1 27 provides that, in such cases, the utility board shall have 1 28 jurisdiction if a water rates board governing water rates= 1 29 related issues of the privately owned water well has not been 1 30 established, which has the jurisdiction, at a minimum, to 1 31 approve or disapprove water rate increases and to provide 1 32 final and binding decisions for water rates complaints. 1 33 LSB 1486HH 80 1 34 tm/sh/8 1 35
