  1  1    Section 1.  NEW SECTION.  455B.307B  ENVIRONMENTAL HEALTH
  1  2 SPECIALIST == POWERS.
  1  3    1.  The board of supervisors of each county may grant the
  1  4 environmental health specialist of the county the power to
  1  5 enforce the provisions of sections 455B.307A and 455B.363 and
  1  6 local littering ordinances.  If these powers are granted, the
  1  7 powers shall be in addition to any other duties and
  1  8 responsibilities assigned to the environmental health
  1  9 specialist by the board of supervisors and the environmental
  1 10 health specialist shall take an oath of office prescribed by
  1 11 the board of supervisors.  The environmental health specialist
  1 12 may enter upon any public land in the county, excluding land
  1 13 within the limits of cities, unless otherwise authorized by a
  1 14 city, at any time for the performance of the environmental
  1 15 health specialist's duties under this section, and may hire
  1 16 the labor and equipment necessary subject to the approval of
  1 17 the board of supervisors.
  1 18    2.  A person shall not willfully obstruct, resist, impede,
  1 19 or interfere with a county environmental health specialist in
  1 20 connection with the environmental health specialist's
  1 21 enforcement of sections 455B.307A and 455B.363 and local
  1 22 littering ordinances.  A person shall not willfully retaliate
  1 23 or discriminate in any manner against an environmental health
  1 24 specialist as a reprisal for any act or omission of the
  1 25 environmental health specialist.  A person violating this
  1 26 subsection is guilty of a simple misdemeanor.
  1 27                           EXPLANATION
  1 28    This bill relates to powers of environmental health
  1 29 specialists.
  1 30    The bill allows a county board of supervisors to grant a
  1 31 county environmental health specialist the power to enforce
  1 32 laws relating to the discarding of solid waste and littering,
  1 33 as well as local littering ordinances.  The bill provides that
  1 34 these powers would be in addition to any other duties and
  1 35 responsibilities assigned to the environmental health
  2  1 specialist.  The bill allows the environmental health
  2  2 specialist to enter upon any public land in the county,
  2  3 excluding land within the limits of cities, unless otherwise
  2  4 authorized by a city, at any time for performance of the
  2  5 environmental health specialist's duties under the bill.
  2  6    The bill provides that a person shall not willfully
