  1  1    Section 1.  Section 514I.4, subsection 4, Code 2003, is
  1  2 amended to read as follows:
  1  3    4.  The department shall do or shall provide for all of the
  1  4 following:
  1  5    a.  Develop a program application form not to exceed two
  1  6 pages in length, which is consistent with the rules of the
  1  7 board, which is easy to understand, complete, and concise, and
  1  8 which, to the greatest extent possible, coordinates with the
  1  9 medical assistance program.
  1 10    b.  Establish the family cost sharing amount, based on a
  1 11 sliding fee scale, if established by amounts of not less than
  1 12 ten dollars per individual and twenty dollars per family, if
  1 13 not otherwise prohibited by federal law, with the approval of
  1 14 the board.
  1 15    c.  Perform annual, random reviews of enrollee applications
  1 16 to ensure compliance with program eligibility and enrollment
  1 17 policies.  Quality assurance reports shall be made to the
  1 18 board and the department based upon the data maintained by the
  1 19 administrative contractor.
  1 20    c. d.  Perform other duties as determined by the department
  1 21 with the approval of the board.
  1 22    Sec. 2.  Section 514I.5, subsection 1, unnumbered paragraph
  1 23 1, Code 2003, is amended to read as follows:
  1 24    A HAWK=I board for the HAWK=I program is established.  The
  1 25 board shall meet not less than ten six and not more than
  1 26 twelve times annually, for the purposes of establishing policy
  1 27 for, directing the department on, and adopting rules for the
  1 28 program.  The board shall consist of seven members, including
  1 29 all of the following:
  1 30    Sec. 3.  Section 514I.5, subsection 7, paragraphs d and e,
  1 31 Code 2003, are amended to read as follows:
  1 32    d.  Develop, with the assistance of the department, an
  1 33 outreach plan, and provide for periodic assessment of the
  1 34 effectiveness of the outreach plan.  The plan shall provide
  1 35 outreach to families of children likely to be eligible for
  2  1 assistance under the program, to inform them of the
  2  2 availability of and to assist the families in enrolling
  2  3 children in the program.  The outreach efforts may include,
  2  4 but are not limited to, a comprehensive statewide media
  2  5 campaign, solicitation of cooperation from programs, agencies,
  2  6 and other persons who are likely to have contact with eligible
  2  7 children, including but not limited to those associated with
  2  8 the educational system, and the development of community plans
  2  9 for outreach and marketing.
  2 10    e.  In consultation with the clinical advisory committee,
  2 11 select a single, nationally recognized functional health
  2 12 assessment form for an initial assessment of all eligible
  2 13 assess the initial health status of children participating in
  2 14 the program, establish a baseline for comparison purposes, and
  2 15 develop appropriate indicators to measure the subsequent
  2 16 health status of eligible children participating in the
  2 17 program.
  2 18    Sec. 4.  Section 514I.5, subsection 7, paragraph i, Code
  2 19 2003, is amended by striking the paragraph.
  2 20    Sec. 5.  Section 514I.5, subsection 7, paragraph l,
  2 21 unnumbered paragraph 1, Code 2003, is amended to read as
  2 22 follows:
  2 23    Establish an advisory committee to make recommendations to
  2 24 the board and to the general assembly on or before by January
  2 25 1, 1999, annually concerning the provision of health insurance
  2 26 coverage to children with special health care needs under the
  2 27 program.  The committee shall include individuals with
  2 28 experience in, knowledge of, or expertise in this area.  The
  2 29 recommendations shall address, but are not limited to, all of
  2 30 the following:
  2 31    Sec. 6.  Section 514I.5, subsection 8, paragraph h, Code
  2 32 2003, is amended to read as follows:
  2 33    h.  The amount of any cost sharing under the program which
  2 34 shall be assessed on a sliding fee scale based on family
  2 35 income, which provides for a minimum amount of cost sharing,
  3  1 and which complies with federal law.
  3  2    Sec. 7.  Section 514I.5, subsection 8, paragraph m, Code
  3  3 2003, is amended by striking the paragraph.
  3  4    Sec. 8.  Section 514I.6, subsection 3, Code 2003, is
  3  5 amended by striking the subsection.
  3  6    Sec. 9.  Section 514I.7, subsection 2, paragraph c, Code
  3  7 2003, is amended to read as follows:
  3  8    c.  Forward names of children who appear to be eligible for
  3  9 medical assistance or other public health insurance coverage
  3 10 to local to the department of human services offices or other
  3 11 appropriate person or agency for follow up follow=up and
  3 12 retain the identifying data on children who are referred.
  3 13    Sec. 10.  Section 514I.7, subsection 2, paragraph h, Code
  3 14 2003, is amended by striking the paragraph.
  3 15    Sec. 11.  Section 514I.8, subsection 2, paragraph e, Code
  3 16 2003, is amended to read as follows:
  3 17    e.  Is not currently covered under or was not covered
  3 18 within the prior six months under a group health plan as
  3 19 defined in 42 U.S.C. } 300gg=91(a)(1) or other health benefit
  3 20 plan, unless the coverage was involuntarily lost or unless
  3 21 dropping the coverage is allowed by rule of the board.
  3 22    Sec. 12.  Section 514I.10, Code 2003, is amended to read as
  3 23 follows:
  3 24    514I.10  COST SHARING.
  3 25    1.  Cost sharing for eligible children whose family income
  3 26 is at or below one hundred fifty percent of the federal
  3 27 poverty level shall not exceed the standards permitted under
  3 28 42 U.S.C. } 1396(o)(a)(3) or } 1396(o)(b)(1).
  3 29    2.  Cost sharing for eligible children whose family income
  3 30 is between equals or exceeds one hundred fifty percent and two
  3 31 hundred percent of the federal poverty level shall may include
  3 32 a premium or copayment amount which is at least a minimum
  3 33 amount but which does not exceed five percent of the annual
  3 34 family income.  The amount of the any premium or the copayment
  3 35 amount shall be based on family income and size.
  4  1    Sec. 13.  MONITORING AND REPORTING REQUIREMENTS.  The
  4  2 department of human services shall monitor the effects of the
  4  3 striking of section 514I.5, subsection 8, paragraph "m", by
  4  4 this Act, until June 30, 2005.  The department shall submit a
  4  5 report to the general assembly annually on January 15, during
  4  6 the period ending June 30, 2005, that includes the reporting
  4  7 of any increased cost of the hawk=i program resulting from the
  4  8 striking of the paragraph described in this section.
