  1  1    Section 1.  Section 702.17, Code 2003, is amended to read
  1  2 as follows:
  1  3    702.17  SEX ACT.
  1  4    The term "sex act" or "sexual activity" means any sexual
  1  5 contact between two or more persons by:  penetration of the
  1  6 penis into the vagina or anus; contact between the mouth and
  1  7 genitalia or by contact between the genitalia of one person
  1  8 and the genitalia or anus of another person; contact between
  1  9 the finger or hand of one person and the genitalia or anus of
  1 10 another person, except in the course of examination or
  1 11 treatment by a person licensed pursuant to chapter 148, 148C,
  1 12 150, 150A, 151, or 152; or by use of artificial sexual organs
  1 13 or substitutes therefor in contact with the genitalia or anus
  1 14 or by penetration of any object into the genitalia or anus
  1 15 except in the course of examination or treatment by a person
  1 16 licensed pursuant to chapter 148, 148C, 150, 150A, 151, or
  1 17 152.
  1 18                           EXPLANATION
  1 19    This bill relates to the definition of a sex act.  The bill
  1 20 modifies the definition of a sex act to include the
  1 21 penetration of any object into the genitalia or anus except in
  1 22 the course of examination or treatment of a person licensed
  1 23 pursuant to Code chapter 148, 148C, 150, 150A, 151, or 152.
  1 24    If an object is in contact with the genitalia or anus,
  1 25 current law requires the object be an artificial sex organ or
  1 26 substitute for an artificial sex organ.
