  1 An Act permitting the use of residential elevators in certain
  2    churches to transport persons with disabilities.

  1  1    Section 1.  Section 89A.3, Code 2003, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  6.  The commissioner shall adopt rules
  1  4 permitting elevators which are permitted for residential use
  1  5 to be used in an eligible church or house of worship where the
  1  6 elevators are only used to transport a restricted number of
  1  7 persons with disabilities.  The rules shall provide that an
  1  8 elevator installed pursuant to this subsection shall be
  1  9 inspected upon the installation of the elevator and shall not
  1 10 be subject to any further inspection.  After inspection, an
  1 11 eligible church or house of worship shall promptly post a sign
  1 12 at the entrance to an elevator installed pursuant to this
  1 13 subsection stating the following:  "In accordance with
  1 14 national consensus safety standards, the labor commissioner
  1 15 has deemed that restricted=use elevators are unsafe except for
  1 16 residential use due to weight restrictions and other safety
  1 17 concerns.  Enter at your own risk."  For purposes of this
  1 18 subsection, an "eligible church or house of worship" means a
  1 19 church or house of worship located in a building constructed
  1 20 prior to July 1, 2003, and with a building capacity of five
  1 21 hundred persons or less.
  1 22                           EXPLANATION
  1 23    This bill requires the labor commissioner to adopt rules
  1 24 allowing residential elevators in eligible churches where the
  1 25 elevators are only used to transport a restricted number of
  1 26 persons with disabilities.  The bill further provides that
  1 27 once an elevator has been installed as permitted by this bill,
  1 28 it shall be subject to inspection only once.  In addition, the
  1 29 bill provides that once the inspection has been completed, the
  1 30 church shall place a warning sign at the entrance to the
  1 31 elevator indicating that the labor commissioner has deemed
  1 32 this type of elevator unsafe except for residential use.  The
  1 33 bill defines eligible churches as churches in buildings
  1 34 constructed prior to July 1, 2003, with a building capacity of
  1 35 500 persons or less.
