1 An Act establishing a prevention of domestic violence special
2 motor vehicle registration plate and providing fees.

1 1 Section 1. Section 321.34, Code 2003, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 23. PREVENTION OF DOMESTIC VIOLENCE
1 4 PLATES.
1 5 a. Upon application and payment of the proper fees, the
1 6 director may issue "prevention of domestic violence" plates to
1 7 an owner referred to in subsection 12.
1 8 b. Prevention of domestic violence plates shall be
1 9 designed by the department in cooperation with the Iowa
1 10 coalition against domestic violence.
1 11 c. The special fee for letter number designated prevention
1 12 of domestic violence plates is thirty=five dollars. The
1 13 special fee for personalized prevention of domestic violence
1 14 plates is twenty=five dollars, which shall be paid in addition
1 15 to the special prevention of domestic violence fee of thirty=
1 16 five dollars. The fees collected by the director under this
1 17 subsection shall be paid monthly to the treasurer of state and
1 18 credited to the road use tax fund. Notwithstanding section
1 19 423.24, and prior to the crediting of revenues to the road use
1 20 tax fund under section 423.24, subsection 1, paragraph "b",
1 21 the treasurer of state shall transfer monthly from those
1 22 revenues to the office of the attorney general for use for
1 23 domestic violence programs the amount of the special fees
1 24 collected in the previous month for the prevention of domestic
1 25 violence plates. Notwithstanding section 8.33, moneys
1 26 transferred under this subsection shall not revert to the
1 27 general fund of the state.
1 28 d. Upon receipt of the special registration plates, the
1 29 applicant shall surrender the current registration receipt and
1 30 plates to the county treasurer. The county treasurer shall
1 31 validate the special registration plates in the same manner as
1 32 regular registration plates are validated under this section.
1 33 The annual special prevention of domestic violence fee for
1 34 letter number designated plates is ten dollars, which shall be
1 35 paid in addition to the regular annual registration fee. The
2 1 annual special fee for personalized prevention of domestic
2 2 violence plates is five dollars, which shall be paid in
2 3 addition to the annual special prevention of domestic violence
2 4 fee and the regular annual registration fee. The annual
2 5 special prevention of domestic violence fee shall be credited
2 6 as provided under paragraph "c".
2 7 EXPLANATION
2 8 This bill establishes a special prevention of domestic
2 9 violence motor vehicle registration plate to be issued by the
2 10 state department of transportation. The plate will be
2 11 designed by the state department of transportation in
2 12 cooperation with the Iowa coalition against domestic violence.
2 13 The special fee for initial issuance of the plate is $35 for
2 14 letter number designated plates and $60 for personalized
2 15 plates. The annual special fee, to be paid in addition to the
2 16 regular annual registration fee, is $10 for letter number
2 17 designated plates and $15 for personalized plates.
2 18 The treasurer of state is directed to transfer the special
2 19 fees from prevention of domestic violence plates to the state
2 20 attorney general to be used for domestic violence programs
2 21 which previously received funding through the domestic abuse
2 22 services income tax checkoff.
