  1  1    Section 1.  Section 6A.21, subsection 1, paragraph b, Code
  1  2 2003, is amended to read as follows:
  1  3    b.  "Private development purposes" means the construction
  1  4 of, or improvement related to, recreational trails in counties
  1  5 with less than two hundred thousand population, recreational
  1  6 development paid for primarily with private funds, housing and
  1  7 residential development, or commercial or industrial
  1  8 enterprise development.
  1  9                           EXPLANATION
  1 10    Current law provides that agricultural land may not be
  1 11 condemned for private development purposes, which includes
  1 12 recreational trails, unless the owner of the land consents to
  1 13 the condemnation.  This bill provides that "private
  1 14 development purposes" includes only recreational trails in
  1 15 counties of less than 200,000 population.
