  1 1 Section 1. Section 331.904, subsection 1, Code 2003, is
1 2 amended to read as follows:
1 3 1. The annual base salary of the first and second deputy
1 4 officer of the office of auditor, treasurer, and recorder, and
1 5 the deputy in charge of the motor vehicle registration and
1 6 title division shall each be an amount not to exceed eighty
1 7 eighty=five percent of the annual base salary of the deputy's
1 8 principal officer. In offices where more than two deputies
1 9 are required, each additional deputy shall be paid an amount
1 10 not to exceed seventy=five eighty percent of the principal
1 11 officer's base salary. The amount of the annual base salary
1 12 of each deputy shall be certified by the principal officer to
1 13 the board and, if a deputy's base salary does not exceed the
1 14 limitations specified in this subsection, the board shall
1 15 certify the base salary to the auditor. The board shall not
1 16 certify a deputy's base salary which exceeds the limitations
  1 17 of this subsection.
1 18 As used in this subsection, "base salary" means the basic
1 19 compensation excluding overtime pay, longevity pay, shift
1 20 differential pay, or other supplemental pay and fringe
  1 21 benefits.
  1 22 Sec. 2. Section 331.904, subsection 2, paragraph e, Code
1 23 2003, is amended to read as follows:
1 24 e. As used in this subsection, "base salary" means the
1 25 basic compensation excluding overtime pay, longevity pay,
1 26 shift differential pay, or other supplement supplemental pay
  1 27 and fringe benefits.
  1 28 EXPLANATION
1 29 This bill provides that the annual base salaries of
1 30 deputies in the offices of the county auditor, county
1 31 treasurer, and county recorder and the deputy in charge of the
1 32 vehicle registration and title division shall not be in an
1 33 amount that exceeds 85 percent, instead of 80 percent, of the
1 34 annual base salary of the deputy's principal officer. The
1 35 bill also provides that in offices where more than two
2 1 deputies are required, the annual base salary of each
2 2 additional deputy shall not exceed 80 percent, instead of 75
2 3 percent, of the principal officer's base salary.
2 4 The bill defines "base salary" as the basic compensation
2 5 excluding overtime pay, longevity pay, shift differential pay,
2 6 or other supplemental pay and fringe benefits.
2 7 The bill also includes a change to subsection 2 of Code
2 8 section 331.904 indicating that "base salary" for deputy
2 9 sheriffs excludes "supplemental" pay, not "supplement" pay.
