  1  1    Section 1.  NEW SECTION.  249A.32  INMATES == ELIGIBILITY.
  1  2    1.  The department shall provide coverage under the medical
  1  3 assistance program to eligible juveniles and adults who are
  1  4 accused of a crime and are in the custody of the juvenile or
  1  5 adult criminal justice system.
  1  6    2.  If eligibility under the medical assistance program is
  1  7 suspended for an individual convicted of a crime who is an
  1  8 inmate of a public institution, the department shall
  1  9 redetermine the inmate's eligibility prior to release of the
  1 10 inmate from the public institution in order to provide the
  1 11 inmate with coverage under the medical assistance program
  1 12 immediately upon release.  For the purposes of this
  1 13 subsection, "inmate of a public institution" means as provided
  1 14 in 42 C.F.R. } 435.1008.
  1 15                           EXPLANATION
  1 16    This bill relates to persons in the custody of the juvenile
  1 17 or criminal justice system and inmates of public institutions
  1 18 and their eligibility under the medical assistance program.
  1 19    The bill requires the department of human services to
  1 20 provide coverage under the medical assistance program to
  1 21 eligible juveniles and adults who are accused of a crime and
  1 22 are in the custody of the juvenile or adult criminal justice
  1 23 system.
  1 24    The bill also provides that if the eligibility under the
  1 25 medical assistance program of an individual who has been
  1 26 convicted of a crime and is an inmate of a public institution
  1 27 has been suspended, the department must redetermine the
  1 28 inmate's eligibility prior to release in order to provide
  1 29 coverage under the medical assistance program immediately upon
  1 30 the inmate's release.
