  1  1    Section 1.  NEW SECTION.  708.2D  ASSAULT == CHOKE HOLD ==
  1  2 PENALTY.
  1  3    A person who commits an assault which is in violation of
  1  4 section 708.2, subsection 5, by applying a choke hold around
  1  5 the throat of a person is guilty of a serious misdemeanor.
  1  6                           EXPLANATION
  1  7    This bill relates to certain assaults using a choke hold.
  1  8 The bill reclassifies a simple misdemeanor assault as a
  1  9 serious misdemeanor if a person applies a choke hold around
  1 10 the throat of another person.
  1 11    A simple misdemeanor is punishable by confinement for no
  1 12 more than 30 days or a fine of at least $50 but not more than
  1 13 $500 or both.  A serious misdemeanor is punishable by
  1 14 confinement for no more than one year and a fine of at least
  1 15 $250 but not more than $1,500.
