NEW SECTION. 483A.28 REGISTRATION OF HUNTING 1 2 OUTFITTERS OR HUNTING GUIDES == PENALTY. 1 3 1. A person shall not engage in or be employed for any 1 4 compensation in the business of a hunting outfitter or a 1 5 hunting guide in this state unless the person is registered as 1 6 a hunting outfitter or a hunting guide with the department. 1 7 The commission shall define, by rule, the activities that 1 8 constitute hunting outfitter activities or hunting guide 1 9 activities for the purposes of this section. The rules shall 1 10 require an applicant for registration to identify the location 1 11 and acreage to be hunted and the equipment and services to be 1 12 provided by the outfitter or the guide. 1 13 2. The department shall establish, by rule, a conduct 1 14 board consisting of hunting outfitters and hunting guides 1 15 selected by the department, to compose standards of ethical 1 16 and professional conduct concerning hunting outfitters and 1 17 hunting guides and to review complaints and make 1 18 recommendations to the department for the revocation of 1 19 registrations of hunting outfitters and hunting guides who are 1 20 in violation of this section or the rules adopted pursuant to 1 21 this section. 1 22 3. The commission shall establish, by rule, the annual fee 1 23 for a hunting outfitter or hunting guide registration required 1 24 pursuant to this section. In determining an annual fee, the 1 25 commission shall consider the costs of providing for the 1 26 registration and administering and enforcing the provisions of 1 27 this section. 1 28 4. A violation of this section or the rules adopted 1 29 pursuant to this section is punishable as provided in section 1 30 483A.42. 1 31 5. This section does not apply to the activities of a 1 32 hunting outfitter or hunting guide that are conducted on a 1 33 hunting preserve pursuant to chapter 484B. 1 34 EXPLANATION 1 35 This bill provides for the registration of persons engaged 2 1 in the business of a hunting outfitter or hunting guide. The 2 2 department of natural resources is directed to define what 2 3 activities constitute hunting outfitter activities or hunting 2 4 guide activities and register hunting outfitters or hunting 2 5 guides upon application and payment of an annual fee 2 6 determined by rule of the natural resource commission. An 2 7 applicant shall identify the location and acreage to be hunted 2 8 and the equipment and services to be provided by the outfitter 2 9 or the hunting guide. 2 10 The bill also requires the department of natural resources 2 11 to establish, by rule, a conduct board consisting of hunting 2 12 outfitters and hunting guides to compose standards of ethics 2 13 and conduct, to review complaints, and to make recommendations 2 14 concerning revocations of registrations of hunting outfitters 2 15 and hunting guides. 2 16 The bill does not apply to activities that are conducted on 2 17 a hunting preserve. 2 18 A violator is guilty of a simple misdemeanor and subject to 2 19 a scheduled fine of $100 for each offense. 2 20 LSB 1943HV 80 2 21 av/pj/5
