  1 An Act authorizing the department of human services to contract
  2    for managed care of adult mental health or substance abuse
  3    services under the medical assistance program under certain
  4    circumstances and providing an effective date.

  1  1    Section 1.  Section 249A.4, Code 2003, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  16.  If specifically authorized by
  1  4 statute, enter into or renew a managed care contract for
  1  5 mental health or substance abuse services under the medical
  1  6 assistance program for the period specified in the statute.
  1  7 The department shall not contract for service management or
  1  8 any other form of service approval for targeted case
  1  9 management services for persons receiving mental health,
  1 10 substance abuse, or developmental disabilities services unless
  1 11 specifically authorized to do so by statute.
  1 12    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  1 13 immediate importance, takes effect upon enactment.
  1 14                           EXPLANATION
  1 15    This bill authorizes the department of human services to
  1 16 contract for managed care of adult mental health or substance
  1 17 abuse services under the medical assistance program for the
  1 18 period specified in the authorizing statute.  The department
  1 19 is prohibited from contracting for service management or any
  1 20 other form of service approval for targeted case management
  1 21 services provided to persons receiving mental health,
  1 22 substance abuse, or developmental disabilities services unless
  1 23 specifically authorized to do so by statute.
  1 24    The bill takes effect upon enactment.
