  1 An Act making an appropriation for and extending the existence of
  2    the Iowa early intervention block grant program, and providing
  3    an effective date.
  4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 256D.4, subsection 2, unnumbered
  1  2 paragraph 1, Code 2003, is amended to read as follows:
  1  3    For each fiscal year in the fiscal period beginning July 1,
  1  4 2001, and ending June 30, 2003 2005, moneys appropriated
  1  5 pursuant to section 256D.5, subsection 3, shall be allocated
  1  6 to school districts as follows:
  1  7    Sec. 2.  Section 256D.4, subsection 3, Code 2003, is
  1  8 amended to read as follows:
  1  9    3.  For each year in which an appropriation is made to the
  1 10 Iowa early intervention block grant program, the department of
  1 11 education shall notify the department of revenue and finance
  1 12 of the amount of the allocation to be paid to each school
  1 13 district as provided in subsections 1 and subsection 2.  The
  1 14 allocation to each school district shall be made in one
  1 15 payment on or about October 15 of the fiscal year for which
  1 16 the appropriation is made, taking into consideration the
  1 17 relative budget and cash position of the state resources.
  1 18 Moneys received under this section shall not be commingled
  1 19 with state aid payments made under section 257.16 to a school
  1 20 district and shall be accounted for by the local school
  1 21 district separately from state aid payments.  Payments made to
  1 22 school districts under this section are miscellaneous income
  1 23 for purposes of chapter 257.  A school district shall maintain
  1 24 a separate listing within its budget for payments received and
  1 25 expenditures made pursuant to this section.  A school district
  1 26 shall certify to the department of education that moneys
  1 27 received under this section were used to supplement, not
  1 28 supplant, moneys otherwise received and used by the school
  1 29 district.
  1 30    Sec. 3.  Section 256D.5, subsection 3, Code 2003, is
  1 31 amended to read as follows:
  1 32    3.  For each fiscal year of the fiscal period beginning
  1 33 July 1, 2001, and ending June 30, 2003 2005, the sum of thirty
  1 34 million dollars.
  1 35    Sec. 4.  Section 256D.9, Code 2003, is amended to read as
  2  1 follows:
  2  2    256D.9  FUTURE REPEAL.
  2  3    This chapter is repealed effective July 1, 2003 2005.
  2  4    Sec. 5.  EFFECTIVE DATE.  This Act, being deemed of
  2  5 immediate importance, takes effect upon enactment.
  2  6                           EXPLANATION
  2  7    This bill extends until FY 2004=2005 the standing $30
  2  8 million general fund appropriation to the department of
  2  9 education for purposes of the Iowa early intervention block
  2 10 grant program, and delays until July 1, 2005, the repeal of
  2 11 the chapter that creates the program.
  2 12    Under the current Code, the funding for the program ends
  2 13 June 30, 2003, and the chapter is repealed effective July 1,
  2 14 2003.
  2 15    The bill takes effect upon enactment.
