1 An Act relating to the definition of veteran and providing an
2 effective date.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 35.1, subsection 2, paragraph b, Code
1 2 2003, is amended by adding the following new subparagraph:
1 3 NEW SUBPARAGRAPH. (5) Former members of the armed forces
1 4 of the United States if any portion of their term of
1 5 enlistment would have occurred within the time period
1 6 specified in paragraph "a", subparagraph (9), but who instead
1 7 opted to serve five years in the reserve forces of the United
1 8 States, as allowed by federal law, and who were discharged
1 9 under honorable conditions.
1 10 Sec. 2. STATE FUNDING. The military service tax
1 11 exemptions and credits provided pursuant to this Act shall be
1 12 funded pursuant to chapter 426A and section 25B.7, subsection
1 13 2.
1 14 Sec. 3. EFFECTIVE AND APPLICABILITY DATES. This Act,
1 15 being deemed of immediate importance, takes effect upon
1 16 enactment.
1 17 EXPLANATION
1 18 This bill modifies the definition of "veteran" to include
1 19 former members of the armed forces of the United States if any
1 20 portion of their term of enlistment would have occurred during
1 21 the Korean conflict but who instead opted to serve five years
1 22 in the reserve forces of the United States, which was an
1 23 option under federal law.
1 24 In response to the requirements of Code section 25B.7, the
1 25 military service tax exemptions and credits resulting from the
1 26 modification to the definition of "veteran" are funded as
1 27 provided in Code chapter 426A.
1 28 The bill takes effect upon enactment.
