  1  1    Section 1.  Section 331.438, subsection 2, paragraph c,
  1  2 Code 2003, is amended to read as follows:
  1  3    c.  The department of human services shall provide for
  1  4 payment of the amount due a county for the county's allowed
  1  5 growth factor adjustment determined in accordance with this
  1  6 subsection.  However, if the state has outstanding billings to
  1  7 a county for mental health, mental retardation, or
  1  8 developmental disabilities services, the billings have been
  1  9 outstanding for one year or more, and the county did not
  1 10 contest the billing during the one=year period, the county's
  1 11 allowed growth factor adjustment payment shall be reduced by
  1 12 the amount of the outstanding billings.  The amount of the
  1 13 reduction of the county's allowed growth factor adjustment
  1 14 payment shall be considered a repayment receipt and shall be
  1 15 credited as though remitted by the county.  The director of
  1 16 human services shall authorize warrants payable to the county
  1 17 treasurer for the amounts due and the warrants shall be mailed
  1 18 in January of each year.  The county treasurer shall credit
  1 19 the amount of the warrant to the county's services fund
  1 20 created under section 331.424A.
  1 21                           EXPLANATION
  1 22    This bill amends Code section 331.438, relating to county
  1 23 mental health, mental retardation, and developmental
  1 24 disabilities services expenditures, to provide for offset of a
  1 25 state payment to reflect outstanding billings to counties for
  1 26 such services.  If the state billings to a county have been
  1 27 outstanding for one year or more and the county has not
  1 28 contested the billings during the one=year period, the
  1 29 county's allowed growth factor adjustment payment for such
  1 30 services made annually in January is reduced by the amount of
  1 31 the outstanding billings.  The amount of the reduction is to
  1 32 be considered a repayment receipt and credited as though
  1 33 remitted by the county.
