1 1 Section 1. Section 321G.1, subsection 1, unnumbered
1 2 paragraph 1, Code 2003, is amended to read as follows:
1 3 1. "All=terrain vehicle" means a motorized flotation=tire
1 4 vehicle with not less than three low pressure tires, but not
1 5 more than six low pressure tires, or a two=wheeled off=road
1 6 motorcycle, that is limited in engine displacement to less
1 7 than eight hundred cubic centimeters and in total dry weight
1 8 to less than seven eight hundred fifty pounds and that has a
1 9 seat or saddle designed to be straddled by the operator and
1 10 handlebars for steering control.
1 11 Sec. 2. Section 321G.13, subsection 3, Code 2003, is
1 12 amended to read as follows:
1 13 3. A person shall not operate an all=terrain vehicle while
1 14 carrying a passenger with more persons on the vehicle than it
1 15 was designed to carry.
1 16 EXPLANATION
1 17 This bill prohibits the operation of an all=terrain vehicle
1 18 with more persons on the vehicle than it was designed to
1 19 carry. Current law does not allow operation of an all=terrain
1 20 vehicle with a passenger on board, regardless of the vehicle's
1 21 design. The bill amends the definition of "all=terrain
1 22 vehicle" to allow for the additional dry weight of all=terrain
1 23 vehicles designed for more than one person.
