  1  1    Section 1.  Section 483A.24, subsection 2, paragraph a,
  1  2 subparagraph (1), Code 2003, is amended to read as follows:
  1  3    (1)  "Family member" means a resident of Iowa person who is
  1  4 the spouse or child of the owner, or is the spouse or child of
  1  5 a tenant and who resides with the owner or tenant.
  1  6    Sec. 2.  Section 483A.24, subsection 2, paragraph a,
  1  7 subparagraph (3), unnumbered paragraph 1, Code 2003, is
  1  8 amended to read as follows:
  1  9    "Owner" means an owner of a farm unit who is a resident of
  1 10 Iowa and who is one of the following:
  1 11    Sec. 3.  Section 483A.24, subsection 2, paragraph a,
  1 12 subparagraph (3), unnumbered paragraph 2, Code 2003, is
  1 13 amended to read as follows:
  1 14    An "owner" does not mean a person who owns a farm unit and
  1 15 who employs a farm manager or third party to operate the farm
  1 16 unit, or a person who owns a farm unit and who rents the
  1 17 entire farm unit to a tenant who is responsible for all farm
  1 18 operations.  However, this paragraph does not apply to an
  1 19 owner who is a parent of the tenant and who resides in this
  1 20 state.
  1 21                           EXPLANATION
  1 22    This bill provides that owners of farm units or their
  1 23 tenants, and their juvenile children may hunt, fish, and trap
  1 24 upon such lands without securing a license to do so, except
  1 25 that a special license to hunt deer and wild turkey is
  1 26 required and can be issued annually without charge, upon
  1 27 application, to the owner of the farm unit or to a member of
  1 28 the owner's family, but not to both, and to the tenant or to a
  1 29 member of the tenant's family, but not to both.
  1 30    The bill changes the definitions of "owner" and "family
  1 31 member" in Code section 483A.24 to provide that an owner of a
  1 32 farm unit or a family member of an owner of a farm unit does
  1 33 not have to be a resident of Iowa.  The bill does not change
  1 34 the requirement that a tenant of a farm unit or a member of a
  1 35 tenant's family has to be a resident of Iowa to qualify under
  2  1 the provisions of Code section 483A.24.
  2  2    The bill also removes the provision that a person is not
  2  3 considered to be an owner for purposes of Code section 483A.24
  2  4 if the person owns a farm unit and employs a farm manager or
  2  5 third party to operate the farm unit or rents the entire farm
  2  6 unit to a tenant who is responsible for all farm operations.
