Section 321.34, Code 2003, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 23. BREAST CANCER AWARENESS PLATES. 1 4 a. Upon application and payment of the proper fees, the 1 5 director may issue breast cancer awareness plates to an owner 1 6 of a motor vehicle referred to in subsection 12. 1 7 b. Breast cancer awareness plates shall contain an image 1 8 of a pink ribbon and shall be designed by the department in 1 9 consultation with the Susan G. Komen foundation. 1 10 c. The special fee for letter number designated breast 1 11 cancer awareness plates is thirty=five dollars. The fee for 1 12 personalized breast cancer awareness plates is twenty=five 1 13 dollars, which shall be paid in addition to the special breast 1 14 cancer awareness fee of thirty=five dollars. The fees 1 15 collected by the director under this subsection shall be paid 1 16 monthly to the treasurer of state and credited to the road use 1 17 tax fund. Notwithstanding section 423.24, and prior to the 1 18 crediting of revenues to the road use tax fund under section 1 19 423.24, subsection 1, paragraph "b", the treasurer of state 1 20 shall transfer monthly from those revenues to the Iowa 1 21 department of public health the amount of the special fees 1 22 collected in the previous month for the breast cancer 1 23 awareness plates and such funds are appropriated to the Iowa 1 24 department of public health. The Iowa department of public 1 25 health shall distribute one hundred percent of the funds 1 26 received monthly in the form of grants to support breast 1 27 cancer screenings for both men and women who meet eligibility 1 28 requirements like those established by the Susan G. Komen 1 29 foundation. In the awarding of grants, the Iowa department of 1 30 public health shall give first consideration to affiliates of 1 31 the Susan G. Komen foundation and similar nonprofit 1 32 organizations providing for breast cancer screenings at no 1 33 cost in Iowa. Notwithstanding section 8.33, moneys 1 34 transferred under this subsection shall not revert to the 1 35 general fund of the state. 2 1 d. Upon receipt of the special registration plates, the 2 2 applicant shall surrender the current registration receipt and 2 3 plates to the county treasurer. The county treasurer shall 2 4 validate the special registration plates in the same manner as 2 5 regular registration plates are validated under this section. 2 6 The annual special breast cancer awareness fee for letter 2 7 number designated plates is ten dollars, which shall be paid 2 8 in addition to the regular annual registration fee. The 2 9 annual special fee for personalized breast cancer awareness 2 10 plates is five dollars, which shall be paid in addition to the 2 11 annual special breast cancer awareness fee and the regular 2 12 annual registration fee. The annual special breast cancer 2 13 awareness fee shall be credited and transferred as provided 2 14 under paragraph "c". 2 15 EXPLANATION 2 16 This bill establishes a special breast cancer awareness 2 17 motor vehicle registration plate to be issued by the state 2 18 department of transportation. The plate will bear a processed 2 19 emblem with an image of a pink ribbon signifying breast cancer 2 20 awareness. The special fee for initial issuance of the plate 2 21 is $35 for letter number designated plates and $60 for 2 22 personalized plates. The annual special fee, to be paid in 2 23 addition to the regular annual registration fee, is $10 for 2 24 letter number designated plates and $15 for personalized 2 25 plates. 2 26 The special fees from breast cancer awareness plates are 2 27 appropriated to the Iowa department of public health. The 2 28 department shall distribute 100 percent of the funds in the 2 29 form of grants to Iowa affiliates of the Susan G. Komen 2 30 foundation or similar nonprofit organizations operating in 2 31 Iowa to be used for breast cancer screening for men and women 2 32 who meet eligibility requirements like those established by 2 33 the Komen foundation. 2 34 LSB 2099HV 80 2 35 dea/pj/5
