  4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 6A.4, subsection 2, Code 2003, is
  1  2 amended by adding the following new unnumbered paragraph:
  1  3    NEW UNNUMBERED PARAGRAPH.  The right granted in this
  1  4 subsection does not extend to an owner of land who acquired
  1  5 title to the land by tax deed pursuant to chapter 448, or to
  1  6 subsequent owners of the land.
  1  7    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  1  8 immediate importance, takes effect upon enactment and applies
  1  9 to titles to land transferred on or after the effective date.
  1 10                           EXPLANATION
  1 11    This bill provides that an owner of land acquired by tax
  1 12 deed, or a subsequent owner, does not have the right to
  1 13 condemn land for purposes of providing a public way to the
  1 14 land acquired by tax deed.
  1 15    The bill takes effect upon enactment and applies to land
  1 16 title transfers on or after the effective date.
