  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 455D.13, Code 2003, is amended to read
  1  2 as follows:
  1  3    455D.13  LAND DISPOSAL OF WASTE OIL PROHIBITED ==
  1  4 COLLECTION.
  1  5    1.  A sanitary landfill shall not accept waste oil for
  1  6 final disposal beginning July 1, 1990.  Beginning July 1,
  1  7 2004, a sanitary landfill shall not accept waste oil filters
  1  8 or oil=contaminated material for final disposal but may
  1  9 receive such materials for recycling purposes.
  1 10    2.  A person offering for sale or selling oil or oil
  1 11 filters at retail in the state shall do the following:
  1 12    a.  Accept at the point of sale, waste oil, waste oil
  1 13 filters, and oil=contaminated material from customers, or post
  1 14 notice of locations where a customer may dispose of waste oil,
  1 15 waste oil filters, and oil=contaminated material.
  1 16    b.  Post written notice that it is unlawful to dispose of
  1 17 waste oil, waste oil filters, or oil=contaminated material in
  1 18 a sanitary landfill.
  1 19    3.  A sanitary landfill or person offering for sale or
  1 20 selling oil or oil filters at retail or any other person that
  1 21 accepts waste oil filters or oil=contaminated material shall
  1 22 notify the department.  The department shall make a list of
  1 23 such entities available to retailers for purposes of the
  1 24 notification requirements in subsection 2, paragraph "a".
  1 25                           EXPLANATION
  1 26    This bill relates to the recycling of waste oil filters and
  1 27 oil=contaminated material.
  1 28    The bill prohibits the land disposal of waste oil filters
  1 29 and oil=contaminated material beginning July 1, 2004, but
  1 30 allows a sanitary landfill to receive such materials for
  1 31 recycling purposes.  The bill also provides that the notice
  1 32 and collection requirements for waste oil filters and oil=
  1 33 contaminated material are the same as for waste oil.
  1 34    The bill provides that a sanitary landfill or person
  1 35 offering for sale or selling oil or oil filters at retail of
  2  1 any other person that accepts waste oil filters or oil=
  2  2 contaminated material shall notify the department.  The bill
  2  3 provides that the department shall make a list of such
  2  4 entities available to retailers for purposes of the
  2  5 notification requirements.
