  2 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 321.177, subsection 1, Code 2003, is
  1  2 amended to read as follows:
  1  3    1.  To any person who is under the age of eighteen years
  1  4 except as provided in section 321.180B.  However, the
  1  5 department may issue a driver's license to certain minors as
  1  6 provided in section 321.178 or 321.194, or a driver's license
  1  7 restricted to motorized bicycles as provided in section
  1  8 321.189.
  1  9    Sec. 2.  Section 321.178, subsection 1, unnumbered
  1 10 paragraph 5, Code 2003, is amended to read as follows:
  1 11    Any person who successfully completes an approved driver
  1 12 education course at a private or commercial driver education
  1 13 school licensed by the department shall likewise be eligible
  1 14 for a driver's license as provided in section 321.180B or
  1 15 321.194.
  1 16    Sec. 3.  Section 321.180B, unnumbered paragraph 1, Code
  1 17 2003, is amended to read as follows:
  1 18    Persons under age eighteen shall not be issued a license or
  1 19 permit to operate a motor vehicle except under the provisions
  1 20 of this section.  However, the department may issue restricted
  1 21 and special driver's licenses to certain minors as provided in
  1 22 sections section 321.178 and 321.194, and driver's licenses
  1 23 restricted to motorized bicycles as provided in section
  1 24 321.189.  A license or permit shall not be issued under this
  1 25 section or section 321.178 or 321.194 without the consent of a
  1 26 parent or guardian.  An additional consent is required each
  1 27 time a license or permit is issued under this section or
  1 28 section 321.178 or 321.194.  The consent must be signed by at
  1 29 least one parent or guardian on an affidavit form provided by
  1 30 the department.
  1 31    Sec. 4.  Section 321.191, subsection 6, Code 2003, is
  1 32 amended to read as follows:
  1 33    6.  SPECIAL MINORS' LICENSES.  Notwithstanding subsection
  1 34 2, the fee for a driver's license issued to a minor under
  1 35 section 321.194 or a restricted license issued to a minor
  2  1 under section 321.178, subsection 2, is eight dollars.
  2  2    Sec. 5.  Section 321.191, subsection 9, unnumbered
  2  3 paragraph 2, Code 2003, is amended to read as follows:
  2  4    As used in this subsection "to upgrade a license class
  2  5 privilege" means to add any privilege to a valid driver's
  2  6 license.  The addition of a privilege includes converting from
  2  7 a noncommercial to a commercial license, converting from a
  2  8 noncommercial class C to a class D license, converting an
  2  9 instruction permit to a class license, adding any privilege to
  2 10 a section 321.189, subsection 7, license, adding an
  2 11 instruction permit privilege, adding a section 321.189,
  2 12 subsection 7, license to an instruction permit, and adding any
  2 13 privilege relating to a driver's license issued to a minor
  2 14 under section 321.194 or section 321.178, subsection 2.
  2 15    Sec. 6.  Section 321.213, Code 2003, is amended to read as
  2 16 follows:
  2 17    321.213  LICENSE SUSPENSIONS OR REVOCATIONS DUE TO
  2 18 VIOLATIONS BY JUVENILE DRIVERS.
  2 19    Upon the entering of a dispositional order suspending or
  2 20 revoking the driver's license or operating privileges of the
  2 21 juvenile under section 232.52, subsection 2, paragraph "a",
  2 22 the clerk of the juvenile court shall forward a copy of the
  2 23 adjudication and the dispositional order to the department.
  2 24 Notwithstanding section 232.55, a final adjudication in a
  2 25 juvenile court that the child violated a provision of this
  2 26 chapter or chapter 321A or 321J constitutes a final conviction
  2 27 for purposes of section 321.189, subsection 7, paragraph "b",
  2 28 and sections 321.193, 321.194, 321.200, 321.209, 321.210,
  2 29 321.215, 321.555, 321A.17, 321J.2, 321J.3, and 321J.4.
  2 30    Sec. 7.  Section 321A.17, subsection 4, Code 2003, is
  2 31 amended to read as follows:
  2 32    4.  An individual applying for a driver's license following
  2 33 a period of suspension or revocation pursuant to a
  2 34 dispositional order issued under section 232.52, subsection 2,
  2 35 paragraph "a", or under section 321.180B, section 321.210,
  3  1 subsection 1, paragraph "d", or section 321.210A, 321.213A,
  3  2 321.213B, 321.216B, or 321.513, following a period of
  3  3 suspension under section 321.194, or following a period of
  3  4 revocation pursuant to a court order issued under section
  3  5 901.5, subsection 10, or under section 321J.2A, is not
  3  6 required to maintain proof of financial responsibility under
  3  7 this section.
  3  8    Sec. 8.  Section 805.8A, subsection 4, paragraph a, Code
  3  9 2003, is amended to read as follows:
  3 10    a.  For violations under sections 321.174A, 321.180,
  3 11 321.180B, and 321.193, and 321.194, the scheduled fine is
  3 12 thirty dollars.
  3 13    Sec. 9.  Section 321.194, Code 2003, is repealed.
  3 14                           EXPLANATION
  3 15    This bill repeals the school driver's license provision
  3 16 under Code chapter 321, which currently allows a minor between
  3 17 the ages of 14 and 18 who meets certain requirements to
  3 18 operate a motor vehicle to and from the minor's school.
