  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 455B.172, Code 2003, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  10.  The department shall not impose a fee
  1  4 relating to the application for or issuance of a stormwater
  1  5 discharge permit for the construction of a soil and water
  1  6 conservation practice, including but not limited to an
  1  7 impoundment, waterway, or terrace, if the soil and water
  1  8 conservation practice is constructed on land used in
  1  9 agricultural production and its size is less than five acres.
  1 10                           EXPLANATION
  1 11    This bill prohibits the department of natural resources
  1 12 from imposing a fee involving an application to construct a
  1 13 soil and water conservation practice on land used in
  1 14 agricultural production so long as its size is less than five
  1 15 acres.
