  3    breeders, and providing penalties.

  1  1    Section 1.  NEW SECTION.  162.21  MANURE MANAGEMENT ==
  1  2 COMMERCIAL BREEDERS.
  1  3    1.  The department shall be the state agency exclusively
  1  4 charged with the authority to regulate the management of
  1  5 manure, excreta, or other commonly associated wastes of dogs
  1  6 if the dogs are kept by a commercial breeder.  The department
  1  7 shall adopt rules required to administer this section.
  1  8    2.  A commercial breeder who violates a rule adopted by the
  1  9 department is subject to a civil penalty of up to two hundred
  1 10 dollars.  The department may enforce and collect civil
  1 11 penalties according to rules which shall be adopted by the
  1 12 department.  Each violation shall constitute a separate
  1 13 offense.  Moneys collected from civil penalties shall be
  1 14 deposited into the general fund of the state.
  1 15                           EXPLANATION
  1 16    This bill provides that the department of agriculture and
  1 17 land stewardship is the state agency exclusively charged with
  1 18 the authority to regulate the management of manure associated
  1 19 with dogs kept by commercial breeders.  The department shall
  1 20 adopt rules required to administer the bill.  A person who
  1 21 violates a rule adopted by the department is subject to a
  1 22 civil penalty of up to $200.
