  2    into by state departments, institutions, and agencies, and
  3    their representatives, and providing for damages.

  1  1    Section 1.  NEW SECTION.  73.31  STATE CONTRACT PERFORMANCE
  1  2 REQUIREMENTS.
  1  3    1.  The terms and conditions of any contract for services
  1  4 entered into by a state department, institution, or agency, or
  1  5 its representatives, shall require that any person employed in
  1  6 the performance of the contract shall provide the contracting
  1  7 agency with a copy of an official state or federal government=
  1  8 issued identification card containing the person's social
  1  9 security number.  The contracting agency shall conduct a
  1 10 background check to verify the person's identity.
  1 11    2.  All work done under a contract entered into pursuant to
  1 12 subsection 1 shall be performed within the boundaries of the
  1 13 United States.
  1 14    3.  If at any time during the term of a contract entered
  1 15 into in accordance with this section, subsection 2 is
  1 16 violated, the contractor or subcontractor shall pay damages to
  1 17 the state department, institution, or agency in an amount
  1 18 equal to the amount paid by the state department, institution,
  1 19 or agency for the work performed outside the boundaries of the
  1 20 United States.  The agency may also terminate the contract for
  1 21 noncompliance.
  1 22                           EXPLANATION
  1 23    This bill requires all work done under a state contract to
  1 24 be performed within the boundaries of the United States.  The
  1 25 bill also requires any person employed in the performance of a
  1 26 state contract to provide the contracting agency with a copy
  1 27 of an official state or federal government=issued
  1 28 identification card containing the person's social security
  1 29 number.  The contracting agency shall conduct a background
  1 30 check to verify the person's identity.  The bill provides for
  1 31 the payment of damages by a contractor or subcontractor for a
  1 32 violation of the provision requiring that work done under such
  1 33 a contract be performed within United States boundaries.
