  1 An Act relating to the regulation of target shooting near
  2    buildings and feedlots and the regulation of public hunting
  3    near buildings and feedlots and providing an effective date.

  1  1    Section 1.  Section 481A.123, Code 2003, is amended by
  1  2 adding the following new subsections:
  1  3    NEW SUBSECTION.  3.  This section does not apply to the
  1  4 discharge of a firearm for the purpose of target shooting on
  1  5 premises posted as a target shooting range, if the premises
  1  6 have been used as a target shooting range prior to the
  1  7 erection of a building inhabited by people or domestic
  1  8 livestock, or prior to the construction of a feedlot, located
  1  9 within two hundred yards of the target shooting range.  This
  1 10 subsection applies only to the erection of a building
  1 11 inhabited by people or domestic livestock or to the
  1 12 construction of a feedlot located within two hundred yards of
  1 13 a target shooting range, that is identified as a target
  1 14 shooting range by the city, county, state, or federal
  1 15 government, which erection or construction occurs on or after
  1 16 the effective date of this Act.
  1 17    As used in this subsection, "target shooting" means the
  1 18 discharge of a firearm at an inanimate object, for amusement
  1 19 or as a test of skill in marksmanship.
  1 20    NEW SUBSECTION.  4.  This section does not apply to the
  1 21 discharge of a firearm on premises identified as a public
  1 22 hunting area, if the premises have been identified as a public
  1 23 hunting area prior to the erection of a building inhabited by
  1 24 people or domestic livestock, or prior to the construction of
  1 25 a feedlot, located within two hundred yards of the public
  1 26 hunting area.  This subsection applies only to the erection of
  1 27 a building inhabited by people or domestic livestock or to the
  1 28 construction of a feedlot located within two hundred yards of
  1 29 a public hunting area, which erection or construction occurs
  1 30 on or after the effective date of this Act.
  1 31    As used in this subsection, "public hunting area" means
  1 32 public lands or waters available for hunting by the public,
  1 33 and identified as a public hunting area by the city, county,
  1 34 state, or federal government.
  1 35    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  2  1 immediate importance, takes effect upon enactment.
  2  2                           EXPLANATION
  2  3    This bill provides that target shooting on premises posted
  2  4 as a target shooting range is exempt from the requirement that
  2  5 a firearm cannot be discharged within 200 yards of a building
  2  6 inhabited by people or domestic livestock, or of a feedlot,
  2  7 unless the owner or tenant has given consent, if the premises
  2  8 have been used as a target shooting range prior to the
  2  9 erection of such a building or construction of a feedlot.  The
  2 10 bill applies only to the erection of such a building or
  2 11 construction of a feedlot within 200 yards of a target
  2 12 shooting range that is identified as such by the city, county,
  2 13 state, or federal government where the erection or
  2 14 construction occurs on or after the effective date of the
  2 15 bill.  For the purposes of the bill, "target shooting" means
  2 16 the discharge of a firearm at an inanimate object, for
  2 17 amusement or as a test of skill in marksmanship.  A violation
  2 18 of Code section 481A.123 is punishable by a scheduled fine of
  2 19 $25 under Code section 805.8B.
  2 20    The bill also provides that the discharge of a firearm on
  2 21 premises posted as a public hunting area is exempt from the
  2 22 requirement that a firearm cannot be discharged within 200
  2 23 yards of a building inhabited by people or domestic livestock,
  2 24 or of a feedlot, if the premises have been identified as a
  2 25 public hunting area prior to the erection of such a building
  2 26 or construction of a feedlot.  The provision applies only to
  2 27 the erection of such a building or construction of a feedlot
  2 28 within 200 yards of a public hunting range that is identified
  2 29 as such by the city, county, state, or federal government and
  2 30 where the erection or construction occurs on or after the
  2 31 effective date of the bill.
  2 32    The bill is effective upon enactment.
