1 An Act regulating the transportation of animal carcasses, and
2 providing for fees.

1 1 Section 1. Section 167.4, Code 2003, is amended to read as
1 2 follows:
1 3 167.4 APPLICATION FOR LICENSE.
1 4 Application An application for such a license required
1 5 under this chapter shall be made to the department on forms
1 6 provided by it, which the department. The application shall
1 7 set forth the name and residence of the applicant, the
1 8 proposed place of business, and the particular method which
1 9 the applicant intends to employ in disposing of such dead
1 10 bodies animal carcasses, and such other information as the
1 11 department may require. Said A person engaged in the
1 12 operation of a disposal plant shall submit an application
1 13 shall be accompanied by a fee of one hundred dollars. A
1 14 person not engaged in operating a disposal plant is not
1 15 required to pay an application fee.
1 16 Sec. 2. Section 167.6, Code 2003, is amended to read as
1 17 follows:
1 18 167.6 LICENSE.
1 19 On the receipt of the foregoing certificate, and the
1 20 additional payment of one hundred dollars, the department
1 21 shall issue a license to the applicant to conduct such the
1 22 business of disposing of animal carcasses, at the place
1 23 specified in the application, for one calendar year, but.
1 24 However, the department shall not issue a license for a
1 25 disposal plant not located within the boundaries of the state
1 26 of Iowa. The department shall charge a person engaged in the
1 27 operation of a disposal plant a license fee of one hundred
1 28 dollars. The department shall charge a person not engaged in
1 29 operating a disposal plant a license fee of fifty dollars.
1 30 Sec. 3. Section 167.15, Code 2003, is amended by striking
1 31 the section and inserting the lieu thereof the following:
1 32 167.15 TRANSPORTATION OF ANIMALS == CARCASSES OR PARTS.
1 33 1. A person required to be licensed under section 167.3
1 34 shall transport a whole or part of an animal carcass or offal
1 35 material according to requirements adopted by departmental
2 1 rule.
2 2 a. The vehicle's container used for loading and
2 3 transporting the carcass or offal material shall be
2 4 constructed according to departmental rules in a manner that
2 5 prevents parts or liquids associated with the carcass or offal
2 6 material from escaping during transport.
2 7 b. The department shall adopt rules requiring that the
2 8 vehicle's container be covered when transporting an animal
2 9 carcass or offal material. However, this requirement shall
2 10 not apply to a route vehicle used primarily to transport
2 11 animal carcasses from a farm to another location.
2 12 c. The person shall not overload the vehicle's container
2 13 with carcasses or offal material.
2 14 2. The department shall provide for the inspection of
2 15 vehicles used to transport carcasses or offal material,
2 16 disposal plants, or other locations in which carcasses or
2 17 offal material is stored or processed before being delivered
2 18 to a disposal plant.
2 19 EXPLANATION
2 20 This bill amends Code chapter 167, which provides for the
2 21 transportation and rendering of animal carcasses by persons
2 22 licensed by the department of agriculture and land
2 23 stewardship.
2 24 Code sections 167.4 and 167.6 require a person who is
2 25 engaged in the business of disposing of animal carcasses to
2 26 pay the department an application fee of $100 and a license
2 27 fee of $100. The bill provides that for persons who do not
2 28 operate a disposal plant (who exclusively transport animal
2 29 carcasses), there is no application fee and a $50 license fee.
2 30 Code section 167.15 provides that the conveyance used in
2 31 the transportation of animal carcasses must be covered and
2 32 watertight. The bill rewrites the Code section to apply to a
2 33 whole or part of an animal carcass or related offal material.
2 34 The bill authorizes the department to regulate the loading and
2 35 transporting of such items. It retains a requirement that a
3 1 vehicle's container be covered, but excludes a route vehicle
3 2 used primarily to transport animal carcasses from a farm to
3 3 another location.
