1 An Act relating to work=related injuries that occur outside the
2 state.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 85.71, subsections 1, 2, and 3, Code
1 2 2003, are amended by striking the subsections and inserting in
1 3 lieu thereof the following:
1 4 1. The employer of the employee has a place of business in
1 5 this state and the employee regularly works at or from this
1 6 place of business.
1 7 2. The employer of the employee has a place of business in
1 8 this state and the employee is domiciled in this state.
1 9 3. The employee is working under a contract of hire made
1 10 in this state and the employee spends a substantial part of
1 11 the employee's working time either working for the employer in
1 12 this state or performing work for the employer in another
1 13 state that is connected to this state.
1 14 3A. The employee is working under a contract of hire made
1 15 in this state and sustains an injury while working in another
1 16 state, for which no remedy is available under the workers'
1 17 compensation laws of the state where the injury occurred.
1 18 EXPLANATION
1 19 This bill provides that if an employee suffers an injury or
1 20 dies while working outside the state, the employee or the
1 21 employee's dependents are entitled to the same workers'
1 22 compensation benefits that would have been provided if the
1 23 injury or death had occurred in the state if the employer of
1 24 the employee has a place of business in this state and the
1 25 employee regularly works at or from this place of business;
1 26 the employer has a place of business in this state and the
1 27 employee is domiciled in this state; the employee is working
1 28 under a contract of hire made in this state and the employee
1 29 spends a substantial part of the employee's working time
1 30 either working for the employer in this state or performing
1 31 work for the employer in another state that is connected to
1 32 this state; or the employee is working under a contract of
1 33 hire made in this state and sustains an injury while working
1 34 in another state, for which no remedy is available under the
1 35 workers' compensation laws of the state where the injury
2 1 occurred.
