1 1 Section 1. Section 237A.3A, subsection 3, Code Supplement
1 2 2003, is amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. d. The standards for provider
1 4 qualifications under category "C" which are applicable at
1 5 times when more than one qualified provider must be present
1 6 shall require one of the providers to meet the provider
1 7 qualifications for category "C" and allow any other providers
1 8 required to be present to meet the provider qualifications for
1 9 either category "B" or "C".
1 10 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 11 immediate importance, takes effect upon enactment.
1 12 EXPLANATION
1 13 This bill relates to the standards for child development
1 14 home provider qualifications adopted as rules by the
1 15 department of human services.
1 16 Under current law, the department standards for the child
1 17 development homes are required to utilize three categories
1 18 ("A", "B", and "C") ranked from least stringent to most
1 19 stringent. The bill applies to the standards for provider
1 20 qualifications in category "C" when more than one provider is
1 21 required to be present. The bill provides that one of the
1 22 providers present must meet the provider qualifications for
1 23 category "C", but other providers required to be present shall
1 24 be allowed to meet the provider qualifications for either
1 25 category "B" or "C".
1 26 The bill takes effect upon enactment.
