1 An Act relating to registration fees for certain motor trucks.

1 1 Section 1. Section 321.109, subsection 1, unnumbered
1 2 paragraph 1, Code 2003, is amended to read as follows:
1 3 The annual fee for all motor vehicles including vehicles
1 4 designated by manufacturers as station wagons, and 1993 and
1 5 subsequent model years for multipurpose vehicles, except motor
1 6 trucks subject to fees determined under section 321.121 or
1 7 321.122, motor homes, ambulances, hearses, motorcycles, motor
1 8 bicycles, and 1992 and older model years for multipurpose
1 9 vehicles, shall be equal to one percent of the value as fixed
1 10 by the department plus forty cents for each one hundred pounds
1 11 or fraction thereof of weight of vehicle, as fixed by the
1 12 department. The weight of a motor vehicle, fixed by the
1 13 department for registration purposes, shall include the weight
1 14 of a battery, heater, bumpers, spare tire, and wheel.
1 15 Provided, however, that for any new vehicle purchased in this
1 16 state by a nonresident for removal to the nonresident's state
1 17 of residence the purchaser may make application to the county
1 18 treasurer in the county of purchase for a transit plate for
1 19 which a fee of ten dollars shall be paid. And provided,
1 20 however, that for any used vehicle held by a registered dealer
1 21 and not currently registered in this state, or for any vehicle
1 22 held by an individual and currently registered in this state,
1 23 when purchased in this state by a nonresident for removal to
1 24 the nonresident's state of residence, the purchaser may make
1 25 application to the county treasurer in the county of purchase
1 26 for a transit plate for which a fee of three dollars shall be
1 27 paid. The county treasurer shall issue a nontransferable
1 28 certificate of registration for which no refund shall be
1 29 allowed; and the transit plates shall be void thirty days
1 30 after issuance. Such purchaser may apply for a certificate of
1 31 title by surrendering the manufacturer's or importer's
1 32 certificate or certificate of title, duly assigned as provided
1 33 in this chapter. In this event, the treasurer in the county
1 34 of purchase shall, when satisfied with the genuineness and
1 35 regularity of the application, and upon payment of a fee of
2 1 ten dollars, issue a certificate of title in the name and
2 2 address of the nonresident purchaser delivering the same to
2 3 the person entitled to the title as provided in this chapter.
2 4 The provisions of this subsection relating to multipurpose
2 5 vehicles are effective January 1, 1993, for all 1993 and
2 6 subsequent model years. The annual registration fee for
2 7 multipurpose vehicles that are 1992 model years and older
2 8 shall be in accordance with section 321.124.
2 9 Sec. 2. Section 321.122, subsection 1, Code 2003, is
2 10 amended to read as follows:
2 11 1. The annual registration fee for truck tractors, road
2 12 tractors, motor trucks referred to in paragraph "a", and motor
2 13 trucks with a gross weight exceeding six tons, except motor
2 14 trucks registered as special trucks, shall be based on the
2 15 combined gross weight of the vehicle or combination of
2 16 vehicles. All such trucks, truck tractors, or road tractors
2 17 shall be registered for a gross weight equal to or in excess
2 18 of the unladen weight of the vehicle or combination of
2 19 vehicles. The annual registration fee for such vehicles or
2 20 combination of vehicles, except special trucks, shall be:
2 21 a. (1) For If the registration is a renewal and the
2 22 initial registration by the current registrant took effect
2 23 prior to July 1, 2003, for a combined gross weight of three
2 24 tons or less sixty=five dollars and, for a vehicle which is
2 25 more than ten model years old fifty=five dollars and, for a
2 26 vehicle which is more than thirteen model years old forty=five
2 27 dollars, and for a vehicle which is more than fifteen years
2 28 old thirty=five dollars.
2 29 (2) If the registration is a renewal and the initial
2 30 registration by the current registrant took effect prior to
2 31 July 1, 2003, for a combined gross weight exceeding three tons
2 32 but not exceeding four tons eighty dollars, for a combined
2 33 gross weight exceeding four tons but not exceeding five tons
2 34 ninety dollars, and for a combined gross weight exceeding five
2 35 tons but not exceeding six tons one hundred five dollars.
3 1 b. For a combined gross weight exceeding three six tons,
3 2 the annual registration fee shall be as set forth in the
3 3 following schedule:

4 9 c. For a combined gross weight exceeding forty tons, the
4 10 annual registration fee shall be one thousand six hundred
4 11 ninety=five dollars plus eighty dollars for each ton over
4 12 forty tons.
4 13 EXPLANATION
4 14 This bill phases in an elimination of the flat fee
4 15 currently charged for registration of motor trucks with a
4 16 gross weight of six tons or less. The bill subjects such
4 17 trucks to an annual registration fee based on the value and
4 18 weight of the vehicle, as determined by the state department
4 19 of transportation in the manner currently used to calculate
4 20 fees for other types of motor vehicles. The fee is
4 21 automatically reduced for vehicles more than five model years
4 22 old. However, an owner who registered a motor truck prior to
4 23 July 1, 2003, and paid a flat fee for the registration, will
4 24 continue to be charged a flat fee for renewals of that
4 25 registration. The new fee schedule will apply when ownership
4 26 of the motor truck transfers, and for subsequent renewals.
4 27 The registration fees for special trucks for farm use are
4 28 not affected by this bill.
