  1 An Act modifying specific salary restrictions imposed on the
  2    deputy positions in certain county offices.
  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 331.904, subsection 1, Code 2003, is
  1  2 amended to read as follows:
  1  3    1.  The annual base salary of the first and second deputy
  1  4 officer of the office of auditor, treasurer, and recorder, and
  1  5 the deputy in charge of the motor vehicle registration and
  1  6 title division shall each be an amount not to exceed eighty
  1  7 eighty=five percent of the annual salary of the deputy's
  1  8 principal officer.  In offices where more than two deputies
  1  9 are required, the annual base salary of each additional deputy
  1 10 shall be paid an amount not to exceed seventy=five eighty
  1 11 percent of the principal officer's salary.  The amount of the
  1 12 annual base salary of each deputy shall be certified by the
  1 13 principal officer to the board and, if a deputy's salary does
  1 14 not exceed the limitations specified in this subsection, the
  1 15 board shall certify the base salary to the auditor.  The board
  1 16 shall not certify a deputy's base salary which exceeds the
  1 17 limitations of this subsection.  As used in this subsection,
  1 18 "base salary" means the basic compensation excluding overtime
  1 19 pay, longevity pay, shift differential pay, or other
  1 20 supplemental pay and fringe benefits.
  1 21                           EXPLANATION
  1 22    This bill eliminates the current Code restriction that the
  1 23 salary of a first or second deputy in the office of auditor,
  1 24 treasurer, and recorder, and the deputy in charge of the motor
  1 25 vehicle registration and title division cannot exceed 80
  1 26 percent of the salary of the deputy's principal officer,
  1 27 changing the limit to 85 percent.
  1 28    The bill also changes references from "salary" to "base
  1 29 salary" and provides a definition for that term.
