1 An Act appropriating special Pearl Harbor and United States armed
2 forces retired motor vehicle registration plate fees to the
3 commission of veterans affairs.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 35A.11, Code 2003, is amended to read
1 2 as follows:
1 3 35A.11 VETERANS LICENSE FEE FUND.
1 4 A veterans license fee fund is created in the state
1 5 treasury under the control of the commission. The fund shall
1 6 include the fees credited by the treasurer of state from the
1 7 sale of special veteran license motor vehicle registration
1 8 plates pursuant to section 321.34, subsection 13, paragraph
1 9 "d", special Pearl Harbor registration plates pursuant to
1 10 section 321.34, subsection 17, and special United States armed
1 11 forces retired registration plates pursuant to section 321.34,
1 12 subsection 19. Notwithstanding section 12C.7, interest or
1 13 earnings on moneys in the veterans license fee fund shall be
1 14 credited to the veterans license fee fund. Moneys in the fund
1 15 are appropriated to the commission to be used to fulfill the
1 16 responsibilities of the commission.
1 17 Sec. 2. Section 321.34, subsections 17 and 19, Code
1 18 Supplement 2003, are amended to read as follows:
1 19 17. PEARL HARBOR SPECIAL PLATES.
1 20 a. An owner referred to in subsection 12 who was at Pearl
1 21 Harbor, Hawaii, as a member of the armed services of the
1 22 United States on December 7, 1941, may, upon written
1 23 application to the department, order special registration
1 24 plates with a Pearl Harbor processed emblem. The emblem shall
1 25 be designed by the department in consultation with service
1 26 organizations. The application is subject to approval by the
1 27 department.
1 28 b. The special fees collected pursuant to subsection 12
1 29 for issuance and annual validation of the special registration
1 30 plates issued under this subsection shall be paid monthly to
1 31 the treasurer of state and credited to the road use tax fund.
1 32 Notwithstanding section 423.24 and prior to the crediting of
1 33 the revenues to the road use tax fund under section 423.24,
1 34 subsection 1, paragraph "b", the treasurer of state shall
1 35 credit monthly to the veterans license fee fund under section
2 1 35A.11 the amount of the special fees collected in the
2 2 previous month for the Pearl Harbor plates.
2 3 19. UNITED STATES ARMED FORCES RETIRED SPECIAL PLATES.
2 4 a. An owner referred to in subsection 12 who is a retired
2 5 member of the United States armed forces may, upon written
2 6 application to the department and upon presentation of
2 7 satisfactory proof of membership, order special registration
2 8 plates with a United States armed forces retired processed
2 9 emblem. The emblem shall be designed by the department in
2 10 consultation with service organizations. The application is
2 11 subject to approval by the department. For purposes of this
2 12 subsection, a person is considered to be retired if the person
2 13 is recognized by the United States armed forces as retired
2 14 from the United States armed forces.
2 15 b. The special fees collected pursuant to subsection 12
2 16 for issuance and annual validation of the special registration
2 17 plates issued under this subsection shall be paid monthly to
2 18 the treasurer of state and credited to the road use tax fund.
2 19 Notwithstanding section 423.24 and prior to the crediting of
2 20 the revenues to the road use tax fund under section 423.24,
2 21 subsection 1, paragraph "b", the treasurer of state shall
2 22 credit monthly to the veterans license fee fund under section
2 23 35A.11 the amount of the special fees collected in the
2 24 previous month for the United States armed forces retired
2 25 plates.
2 26 EXPLANATION
2 27 This bill directs the treasurer of state to credit special
2 28 motor vehicle registration plate fees for Pearl Harbor license
2 29 plates and United States armed forces retired license plates
2 30 to the veterans license fee fund under the control of the
2 31 commission of veterans affairs. Moneys in that fund are
2 32 appropriated to the commission to be used to fulfill its
2 33 responsibilities. The fund consists of moneys from the
2 34 special fees for veterans registration plates.
2 35 Pearl Harbor plates are currently available to motor
3 1 vehicle owners who were at Pearl Harbor on December 7, 1941,
3 2 as a member of the armed forces. United States armed forces
3 3 retired plates representing each of the five branches of the
3 4 armed services are currently available to motor vehicle owners
3 5 who are retired from the armed forces. The special fee for
3 6 issuance of these special plates is $25, in addition to the
3 7 regular registration fee for the vehicle. The special annual
3 8 validation fee is $5, which is in addition to the regular
3 9 validation fee for the vehicle. Those special fees are
3 10 currently credited to the road use tax fund.
