  1  1    Section 1.  MEDICAL ASSISTANCE == PERSONAL NEEDS ALLOWANCE.
  1  2 The department of human services shall adopt rules which
  1  3 provide that the personal needs allowance under the medical
  1  4 assistance program, which is retained by a resident of a
  1  5 nursing facility, is seventy=five dollars per month, unless a
  1  6 greater amount is allowed under state or federal law.
  1  7                           EXPLANATION
  1  8    This bill directs the department of human services to adopt
  1  9 rules to allow residents of nursing facilities participating
  1 10 in the medical assistance program to retain a personal needs
  1 11 allowance of $75 per month, unless a greater amount is allowed
  1 12 to be retained under state or federal law.  The current
  1 13 personal needs allowance is $30 per month.
