1 An Act relating to Iowa public employees' retirement system
2 coverage for elected township officials and certain township
3 employees.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 97B.1A, subsection 8, paragraph a,
1 2 subparagraph (1), Code Supplement 2003, is amended to read as
1 3 follows:
1 4 (1) Elective officials in positions for which the
1 5 compensation is on a fee basis, elective officials of school
1 6 districts, elective officials of townships, and elective
1 7 officials of other political subdivisions who are in part=time
1 8 positions. An elective official covered under this section
1 9 may terminate membership under this chapter by informing the
1 10 system in writing of the expiration of the member's term of
1 11 office or by informing the system of the member's intent to
1 12 terminate membership for employment as an elective official
1 13 and establishing that the member has a bona fide termination
1 14 of employment from all employment covered under this chapter
1 15 other than as an elective official and that the member has
1 16 filed a completed application for benefits form with the
1 17 system. A county attorney is an employee for purposes of this
1 18 chapter whether that county attorney is employed on a full=
1 19 time or part=time basis.
1 20 Sec. 2. Section 97B.1A, subsection 8, paragraph a, Code
1 21 Supplement 2003, is amended by adding the following new
1 22 subparagraph:
1 23 NEW SUBPARAGRAPH. (12) Persons employed by a township who
1 24 earn less than one hundred dollars in a calendar quarter.
1 25 Sec. 3. Section 97B.1A, subsection 8, paragraph b, Code
1 26 Supplement 2003, is amended by adding the following new
1 27 subparagraph:
1 28 NEW SUBPARAGRAPH. (10) Elective officials of townships.
1 29 EXPLANATION
1 30 This bill removes elected township officers from Iowa
1 31 public employees' retirement system (IPERS) coverage and
1 32 allows township employees earning less than $100 per quarter
1 33 of a calendar year to elect out of IPERS coverage.
