  1  1    Section 1.  Section 96.5, subsection 5, paragraph c, Code
  1  2 2003, is amended by striking the paragraph.
  1  3    Sec. 2.  Section 96.5, subsection 5, unnumbered paragraph
  1  4 2, Code 2003, is amended to read as follows:
  1  5    Provided, that if the remuneration is less than the
  1  6 benefits which would otherwise be due under this chapter, the
  1  7 individual is entitled to receive for the week, if otherwise
  1  8 eligible, benefits reduced by the amount of the remuneration.
  1  9 Provided further, if benefits were paid for any week under
  1 10 this chapter for a period when benefits, remuneration or
  1 11 compensation under paragraph "a", or "b", or "c", were paid on
  1 12 a retroactive basis for the same period, or any part thereof,
  1 13 the department shall recover the excess amount of benefits
  1 14 paid by the department for the period, and no employer's
  1 15 account shall be charged with benefits so paid.  However,
  1 16 compensation for service=connected disabilities or
  1 17 compensation for accrued leave based on military service by
  1 18 the beneficiary with the armed forces of the United States,
  1 19 irrespective of the amount of the benefit, does not disqualify
  1 20 any individual otherwise qualified from any of the benefits
  1 21 contemplated herein.  A deduction shall not be made from the
  1 22 amount of benefits payable for a week for individuals
  1 23 receiving federal social security pensions to take into
  1 24 account the individuals' contributions to the pension program.
  1 25                           EXPLANATION
  1 26    This bill strikes the requirement that governmental and
  1 27 other pensions or retirement pay be considered compensation
  1 28 for determining if an individual is disqualified from
  1 29 receiving unemployment benefits.  Under current law, an
  1 30 individual who is otherwise eligible for unemployment benefits
  1 31 may be disqualified from benefits or may receive reduced
  1 32 benefits if the individual receives income from a pension or
  1 33 retirement plan during any week the individual is not
  1 34 employed.
