  1  1    Section 1.  MEDICAL ASSISTANCE == PERSONAL NEEDS ALLOWANCE.
  1  2 The department of human services shall adopt rules which
  1  3 provide that the personal needs allowance under the medical
  1  4 assistance program, which is retained by a resident of a
  1  5 nursing facility as defined in section 135C.1, is seventy=five
  1  6 dollars per month, unless a greater amount is allowed under
  1  7 state or federal law.
  1  8                           EXPLANATION
  1  9    This bill directs the department of human services to adopt
  1 10 rules to allow residents of nursing facilities participating
  1 11 in the medical assistance program to retain a personal needs
  1 12 allowance of $75 per month, unless a greater amount is allowed
  1 13 to be retained under state or federal law.  The current
  1 14 personal needs allowance is $30 per month.
