  2    revenues and creating an Iowa state patrol fund.

  1  1    Section 1.  NEW SECTION.  80.41  IOWA STATE PATROL FUND.
  1  2    1.  An Iowa state patrol fund is created as a separate fund
  1  3 in the state treasury under the control of the department of
  1  4 revenue.  Notwithstanding section 12C.7, subsection 2,
  1  5 interest and other moneys earned by the fund shall be
  1  6 deposited in the fund.  The fund shall include moneys credited
  1  7 from the use tax as allocated under section 423.43, subsection
  1  8 2.
  1  9    2.  Moneys credited to the fund shall be expended, pursuant
  1 10 to appropriations made from the fund by the general assembly,
  1 11 by the division of the Iowa state patrol of the department of
  1 12 public safety for salaries, including salary adjustment
  1 13 moneys, support, maintenance, and miscellaneous purposes,
  1 14 including workers' compensation expenses and the state's
  1 15 contribution to the peace officers' retirement, accident, and
  1 16 disability system provided in chapter 97A.
  1 17    3.  Notwithstanding section 8.33, moneys credited to the
  1 18 fund which remain unobligated or unexpended at the close of a
  1 19 fiscal year shall not revert to the general fund of the state
  1 20 but shall be credited to the Iowa state patrol fund.
  1 21    Sec. 2.  Section 423.43, subsection 2, as enacted by 2003
  1 22 Iowa Acts, First Extraordinary Session, chapter 2, section
  1 23 136, is amended to read as follows:
  1 24    2.  Notwithstanding any other provision of this section
  1 25 that provides that all revenue derived from the use tax on
  1 26 motor vehicles, trailers, and motor vehicle accessories and
  1 27 equipment as collected pursuant to section 423.26 shall be
  1 28 deposited and credited to the road use tax fund, twenty
  1 29 percent of the revenues shall be credited and deposited as
  1 30 follows:  one=half to the road use tax fund and one=half to
  1 31 the primary road fund to be used for the commercial and
  1 32 industrial highway network, except to the extent that the
  1 33 department directs that moneys are deposited in the Iowa state
  1 34 patrol fund created in section 80.41 to fund the
  1 35 appropriations made from the Iowa state patrol fund in
  2  1 accordance with section 80.41.  The department shall determine
  2  2 the amount of moneys to be credited under this subsection to
  2  3 the Iowa state patrol fund and shall deposit that amount into
  2  4 the Iowa state patrol fund.
  2  5                           EXPLANATION
  2  6    This bill creates an Iowa state patrol fund in the state
  2  7 treasury under the control of the department of revenue.
  2  8 Moneys in the fund are to be spent by the Iowa state patrol
  2  9 division of the department of public safety for salaries,
  2 10 workers' compensation expenses, and the state's contribution
  2 11 to the peace officers' retirement, accident, and disability
  2 12 system, subject to appropriation by the general assembly.
  2 13    The bill provides that in order to fund appropriations from
  2 14 the Iowa state patrol fund, the department of revenue may
  2 15 direct that moneys from the portion of use taxes collected on
  2 16 motor vehicles, trailers, and motor vehicle accessories and
  2 17 allocated for the commercial and industrial highway network be
  2 18 deposited into the Iowa state patrol fund.
