  1  1    Section 1.  Section 481A.93, Code 2003, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  3.  This section does not apply to the use
  1  4 of a spotlight, headlight, or other artificial light by a
  1  5 property owner in an unincorporated area, on the property
  1  6 owner's own property, for the purpose of spotting, locating,
  1  7 or taking or attempting to take a rabbit or fur=bearing animal
  1  8 that is causing damage to the property owner's property.
  1  9                           EXPLANATION
  1 10    This bill allows a property owner in an unincorporated area
  1 11 to use a spotlight, headlight, or other artificial light, on
  1 12 the property owner's own property, to spot, locate, or take or
  1 13 attempt to take a rabbit or fur=bearing animal that is causing
  1 14 damage to the property owner's property.
  1 15    A violation of this provision is a violation under Code
  1 16 section 805.8B, subsection 3, paragraph "e", with a scheduled
  1 17 fine of $100.
