  1  1    Section 1.  Section 232.71B, subsection 9, Code Supplement
  1  2 2003, is amended to read as follows:
  1  3    9.  PHYSICAL EXAMINATION.  If the department refers a child
  1  4 to a physician for a physical examination, photographs, X
  1  5 rays, or other tests, the department shall contact the
  1  6 physician regarding the examination, photographs, X rays, or
  1  7 other tests within twenty=four hours of making the referral.
  1  8 If the physician who performs the examination or orders other
  1  9 tests upon referral by the department reasonably believes the
  1 10 child has been abused, the physician shall report to the
  1 11 department within twenty=four hours of performing the
  1 12 examination or ordering tests.  The costs of the physical
  1 13 examination, photographs, X rays, and any other tests
  1 14 performed or ordered by the physician in connection with the
  1 15 referral shall be paid by the department.
  1 16                           EXPLANATION
  1 17    This bill relates to the costs of physical examinations and
  1 18 related tests performed in the course of a child abuse
  1 19 assessment.  Existing law requires contact between the
  1 20 department and a physician to whom a child is referred for a
  1 21 physical examination during a child abuse assessment.  The
  1 22 bill requires the same contacts to be made when a referral is
  1 23 made for photographs, X rays, or other tests.  In addition,
  1 24 the bill requires the costs of the examination, photographs, X
  1 25 rays, and any other tests performed or ordered by the
  1 26 physician in connection with the referral to be paid by the
  1 27 department of human services.
