  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 481A.142, subsection 5, Code 2003, is
  1  2 amended to read as follows.
  1  3    5.  a.  Sell bait, including minnows, frogs, and clams,
  1  4 propagated or raised within the licensed unit without having
  1  5 to obtain a bait dealer's license.  However, aquaculture units
  1  6 wishing to take bait from areas other than their licensed
  1  7 units must also obtain a bait dealer's license.
  1  8    b.  A nonresident aquaculture unit licensee shall be
  1  9 limited to selling bait at wholesale unless the home state of
  1 10 the nonresident licensee allows residents of this state to
  1 11 sell bait at retail.
  1 12                           EXPLANATION
  1 13    This bill relates to the selling of bait by an aquaculture
  1 14 unit licensee.  Currently, an aquaculture unit licensee is
  1 15 allowed to sell bait propagated or raised within the licensed
  1 16 unit without having to obtain a bait dealer's license.  The
  1 17 bill limits a nonresident aquaculture unit licensee to selling
  1 18 bait at wholesale unless the home state of the nonresident
  1 19 licensee allows residents of this state to sell bait at
  1 20 retail.
