  1  1    Section 1.  NEW SECTION.  516B.4  CERTAIN TRAFFIC ACCIDENTS
  1  2 INVOLVING PEACE OFFICERS NOT CONSIDERED WHEN ESTABLISHING
  1  3 RATES.
  1  4    The commissioner shall require that insurance companies
  1  5 transacting business in this state not consider traffic
  1  6 accidents that occur due to an encounter with a deer while in
  1  7 the course of a person's employment as a peace officer, as
  1  8 defined in section 801.4, for the purpose of establishing
  1  9 rates for motor vehicle insurance charged by the insurer for
  1 10 that person and shall require that insurance companies not
  1 11 cancel or refuse to renew any such policy of that person for
  1 12 such traffic accidents.  The commissioner shall adopt rules to
  1 13 define a traffic accident that occurs due to an encounter with
  1 14 a deer while in the course of a person's employment as a peace
  1 15 officer.
  1 16                           EXPLANATION
  1 17    This bill prohibits insurance companies transacting
  1 18 business in this state from considering traffic accidents that
  1 19 occur due to an encounter with a deer while in the course of a
  1 20 person's employment as a peace officer, as defined in Code
  1 21 section 801.4, for the purpose of establishing rates for motor
  1 22 vehicle insurance charged by the insurer for that person and
  1 23 prohibits insurance companies from canceling or refusing to
  1 24 renew any such policy of that person because of such traffic
  1 25 accidents.  The bill directs the commissioner to adopt rules
  1 26 defining a traffic accident that occurs due to an encounter
  1 27 with a deer while in the course of a person's employment as a
  1 28 peace officer.
